Ord 3315 5/16/1978 ORDINANCE NO, 15/5 AN ORDINANCE AMENDING SECTION 29-77 OF THE WICHITA FALLS CODE OF 1967, AS AMENDED, ENTITLED DISPLAY OF UNAUTHORIZED SIGNS, SIGNALS OR MARKINGS TO INCLUDE PROHIBITION OF CERTAIN NUISANCE LIGHTING, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS TEXAS, THAT: Section 29-77 of the Code of Ordinances of the City of Wichita Falls is hereby amended to read as follows: "Section 29-77. Display of unauthorized signs, signals or markings. (a) No person shall place, maintain or display upon or in close proximity to any public street or highway any unauthorized sign, signal, marking or device which purports to be or is an imitation of or resembles an official traffic-control device or railroad sign or signal, or which attempts to direct the movement of traffic or which hides from view or interferes with the effectiveness of any official traffic-control de- vice or any railroad sign or signal. (b) No person shall place or maintain nor shall any public authority permit upon any highway any traffic sign or signal bearing thereon any commercial adver- tising. (c) No person shall place or maintain within the zone of influence herein defined any outdoor advertising device having exposed incandescent lamps with ratings in excess of 40 watts, having revolving, flashing, steady burn, or strobe operated beacon lights resembling any traffic control signal or emergency vehicle lights, or any sign containing circular red, amber, green, or blue indications, or any flashing device in which more than one-third of the lights do not burn at any one time. Flashing lights and beacons employed for vehicular, marine, or air traffic safety control, or programmed electronic or similar type message displays flashing words or numbers at no more than 35 times per minute are excepted. The zone of influe- nce extends 150 feet measured perpendicular to the edge of any roadway portion which is less than 300 feet from any intersection. Provided, however, this subsection (c) shall not authorize any light or sign which is prohibited by, nor prohibit any light or sign which is authorized by, Subsection (c) of Section 36 of Article 6701d, Revised Civil Statutes of Texas. All noncomplying signs and devices shall be brought into compliance by August 14, 1978. (d) Subsection (a) of this section shall not be deemed to prohibit the erection upon private property adjacent to highways of signs giving useful directional inform- ation and of a type that cannot be mistaken for official signs. (e) Every such prohibited sign, signal or marking is hereby declared to be a public nuisance and the authority having jurisdiction over the highway is hereby empowered to remove the same or cause it to be removed without notice.
