AN ORDINANCE WAIVING FRONTAGE AND SIDE YARD REQUIREMENTS ON
CERTAIN PROPOSED LOTS IN FOUNTAIN PARK, A SUBDIVISION OF THE
CITY OF WICHITA FALLS, TEXAS
WHEREAS, the owners of Fountain Park have requested that frontage
and side yard requirements be waived on a proposed plat of three (3) lots in
Section 4-D; and
WHEREAS, the Planning Board of the City of Wichita Falls has recom-
mended to the Board of Aldermen that said waiver be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Section 9(L) (4) of Ordinance No. 2118 requiring that each
lot shall front upon a public street be and is hereby waived for the proposed
plat of Lots 8 and 9 both in Section 4-D, Fountain Park, which lots do not
front on any public street, as the proposed use is for commercial purposes; and
SECTION 2. Section 9(L) (8) of Ordinance No. 2118 requiring that each
lot shall have a minimum side yard of five (5) feet be and is hereby waived for
the proposed plat of Lots 7, 8 and 9 all in Section 4-D, Fountain Park to allow
construction of buildings for commercial use with common building walls, subject
to the following condition:
The proposed buildings shall be constructed to the same standards
which apply to structures located within the fire districts
