ORDINANCE ALLOWING THE EXTENSION OF ORDINANCE
NO. 2138, WHICH AUTHORIZED SOUTHWESTERN BELL
TELEPHONE COMPANY TO ERECT AND MAINTAIN POLES,
WIRES AND OTHER FACILITIES ALONG PUBLIC
STREETS AND OTHER PUBLIC PLACES, FOR A PERIOD
ENDING SEPTEMBER 30, 1978.
WHEREAS, on March 21, 1978 the Board of Aldermen adopted
Ordinance No. 3299, which renewed Ordinance No. 2138 (which
authorized Southwestern Bell Telephone Company to erect and main-
tain its poles, wires and other facilities along and across all
public streets, alleys and other public places in the City) for a
period ending August 1, 1978, so that the City and the Telephone
Company could resolve their differences concerning the percentage
of annual gross receipts to be paid City by Telephone Company;
and,
WHEREAS, additional time is needed within which to resolve
these differences, and Telephone Company has requested that
Ordinance No. 2138 be renewed for the remainder of the five year
period ending September 30, 1981.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The request of Southwestern Bell Telephone Com-
pany that Ordinance No. 2138 be renewed is hereby allowed for a
period ending September 30, 1978; Ordinance No. 2138 , with the
expanded tax base on gross receipts tax payment to include revenue
collected from customers for advertising in the Wichita Falls
telephone directory whose businesses are located in the City
limits and revenue collected from customers for moves and change
charges completed within the City limits of Wichita Falls, is
hereby renewed for a period ending September 30, 1978.
SECTION 2. The fact that continuation of telephone service
is necessary for the preservation of the peace, health and safety
of property of the City creates an emergency, and this ordinance
is declared an emergency measure, and shall become effective
upon its adoption.
