ORDINANCE ALLOWING THE EXTENSION AND RENEWAL
OF ORDINANCE NO. 2138, WHICH, AUTHORIZED
SOUTHWESTERN BELL TFT,FPHONE COMPANY TO ERECT
AND MAINTAIN POLES, WIRES AND OTHER FACILITIES
ALONG PUBLIC STREETS AND OTHER PUBLIC PLACES,
FOR THE PERIOD ENDING SEPTEMBER 30, 1981.
WHEREAS, the Board of Aldermen of Wichita Falls enacted,
on December 14, 1964, Ordinance No. 2138, which authorized
Southwestern Bell Telephone Company to erect and maintain its
poles, wires and other facilities along and across all public
streets, alleys and other public places in the City, which
ordinance will expire on September 30, 1978; and,
WHEREAS, such ordinance provided that the term thereof
may be renewed until September 30, 1981; the telephone company
has notified the City that it does desire to renew such ordin-
ance for the period ending September 30, 1981.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The request of Southwestern Bell Telephone
Company that Ordinance No. 2138 be renewed for the period end-
ing September 30, 1981 is hereby granted and allowed; ordinance
No. 2138, with the expanded tax base on gross receipts tax pay-
ment to include revenue collected from customers for advertising
in the Wichita Falls telephone directory whose businesses are
located in the City limits and revenue collected from customers
for moves and change charges completed within the City limits,
is hereby renewed and extended for the period ending September
30, 1981.
SECTION 2. The fact that continuation of telephone service
is necessary for the preservation of the peace, health and
safety of property of the City creates an emergency, and this
ordinance is declared an emergency measure, and it shall become
effective upon its adoption.
