Ord 3363 9/5/1978 . . ORDINANCE NO, 4ti ORDINANCE PROHIBITING POSSESSION AND/OR CONSUMPTION OF ALCOHOLIC BEVERAGES IN CERTAIN PARKS IN THE CITY OF WICHITA FALLS. SECTION 1. The possession of alcoholic beverages, and the consumption of alcoholic beverages, in any park in the City of Wichita Falls and in all public street rights-of-way abutting any such park is prohibited. SECTION 2. There is exempted from the operation of Sec- tion 1 of this ordinance that part of Weeks Park which is included in the Weeks Park municipal golf course. SECTION 3. There is exempted from the operation of Sec- tion 1 of this ordinance any function held in the picnic shelter at Lucy Park or the picnic shelter at Weeks Park when such picnic shelter is reserved for such function with the City Parks and Recreation Department in advance, and the Parks and Recreation Department has authorized the consumption of alco- holic beverages at such function. The Parks and Recreation 1 Department shall authorize such consumption unless the persons seeking such authority have, in the past, been guilty of breaches of the peace. SECTION 4. Any person who is convicted of violating this ordinance shall be punished by a fine not exceeding $200. 00. SECTION 5. Ordinance No. 3018 (which is codified as Sec- tion 22-4 of the Code of Ordinances) , as amended by Ordinances No. 3027 , 3066, 3072 and 4008, is hereby repealed. SECTION 6. The fact that the possession and consumption of alcoholic beverages in the parks can be detrimental to the health, safety and welfare of persons and property creates an 1 emergency, and this ordinance is declared to be an emergency measure which shall become effective immediately upon its pas- sage.
