ORDINANCE GRANTING AUTHORITY TO BETHANIA
HOSPITAL TO CONSTRUCT AN OVERHEAD BRIDGE,
AN UNDERGROUND TUNNEL AND A PIPE TUNNEL
OVER AND UNDER THE ALLEY IN BLOCK 262
OF THE ORIGINAL TOWN OF WICHITA FALLS.
WHEREAS, Bethania Hospital is constructing new
facilities on the north side of Block 262 of the original
town of Wichita Falls, which is across the alley from its
present facility, and it has requested authority from the
City of Wichita Falls to construct an overhead bridge above
the alley, and an underground tunnel and an underground pipe
tunnel beneath such alley.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Bethania Hospital is hereby granted the
right and the authority to construct an overhead bridge con-
nection between the existing second floor of the hospital
and the new surgery facility which it is constructing on Lot
4A of Block 262 , a replat of Lots4-7 and the East three fourths
of Lot 8, Block 262, Thompson subdivision of the City of
Wichita Falls. The vertical clearance from the surface of
the alley to the underside of the bridge will be at least 12 '
9" . Bethania Hospital shall construct and maintain adequate
warning devices, to warn motorists in the alley of the exit-
ence of the bridge connection.
SECTION 2. Bethania Hospital is hereby granted the
right and authority to construct an underground tunnel con-
nection between the existing hospital' s basement level and
the new loading dock which it is constructing on said Lot 4A,
and the Hospital is granted the right and authority to make
a pipe tunnel connection between the existing pipe tunnel
under the alley and new surgery facility.
SECTION 3. The hospital shall co-ordinate such construction
with all utility companies whose facilities are located in
the alley.
SECTION 4. It shall be the responsibility of the hos-
pital at all times to maintain said overhead bridge connection
and underground tunnel connections at its own expense. If
at any time in the future some public use of such alley makes
it necessary that the overhead bridge connection or the under-
ground tunnels be relocated or removed, such relocation or
removal shall be done at the sole cost and expense of the
hospital.
SECTION 5. Whenever any work is being done on the
overhead bridge connection and the underground tunnels, the
hospital shall take all necessary and proper precautions to
protect the public from damages. The hospital shall hold and
save the City of Wichita Falls harmless from all damages or
claims for damages resulting from the construction, mainte-
nance and location of such overhead bridge connection and
underground tunnels.
SECTION 6. The right and authority hereby granted is
for so long as said overhead bridge connection and under-
ground tunnels are used and maintained by said hospital.
When the overhead bridge connection and the underground tun-
nel connections, or either of them, is no longer used, they
shall be removed by the hospital at its sole cost and expense.
SECTION 7. This ordinance shall become effective only
after Bethania Hospital delivers a recordable instrument
granting to City two easements, one on each side of the over-
head bridge, from the alley to Tenth Street across the hospital
parking lot on the north side of the block, for egress from
the alley for trucks higher than 12 feet 9 inches.
