ORDINANCE AUTHORIZING TEMPORARY CLOSING OF 7TH
STREET AT THE FORT WORTH AND DENVER RAILROAD
CROSSING FROM JANUARY 15, UNTIL MARCH 2, 1979.
WHEREAS, the City of Wichita Falls, the State of Texas
and Fort Worth and Denver Railway Company executed a contract
dated November 23 , 1977 , providing for installation of grade
crossing warning systems at the location where 7th Street
crosses the Fort Worth and Denver Railway Company line; and,
WHEREAS, such railroad company plans to completely re-
build such crossing, including the construction of a new
main line and rebuilding di of all of the other tracks at that
location, and has requested the City to close 7th Street at
this crossing during the period of such construction, in order
to allow the work to be completed in the most expedient manner
possible.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS, THAT:
7th Street shall be closed at the point where it crosses
the Fort Worth and Denver Railway Company line temporarily
for the period from January 16, 1979, through March 2, 1979.
The Fort Worth and Denver Railway Company shall hold
the City of Wichita Falls harmless from damages proximately
caused by the negligence of such railroad, its agents, employees
and contractors arising out of the closing of such street.
The fact that this work will make such crossing a safer
crossing for the citizens of Wichita Falls makes this ordinance
an emergency measure, and it shall become effective immediately
upon its passage.
