AN ORDINANCE CALLING REGULAR MUNICIPAL ELECTION
TO BE HELD APRIL 7, 1979, FOR ELECTION OF THREE
MEMBERS TO THE BOARD OF ALDERMEN AND FOR SUB-
MITTING PROPOSED AMENDMENTS TO THE CITY CHARTER
OF THE CITY CHARTER OF THE CITY OF WICHITA
FALLS; SETTING FORTH THE PROPOSED AMENDMENTS;
PRESCRIBING THE FORM OF THE BALLOT; DESIGNAT-
ING THE PRECINCTS AND POLLING PLACES AT WHICH
THE ELECTION SHALL BE HELD; AND REQUIRING THE
PUBLISHING OF NOTICE OF THE ELECTION.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS :
SECTION 1. That a regular municipal election shall
be held on the first Saturday in April, 1979, being the
7th day of April, 1979 , for the purposes of electing three
members to the Board of Aldermen of the City and for sub-
mitting propositions to adopt amendments to the City Charter
of the City of Wichita Falls.
SECTION 2. The election called for above shall be held
for the purpose of electing the following officials of said
City:
Alderman . . . Place One
Alderman . . . Place Two
Alderman . . . Place three.
SECTION 3. The regular municipal election called for
above shall also be for the purpose of submitting proposi-
tions to adopt amendments to the City Charter of the City
of Wichita Falls, the proposed amended sentence reading as
follows (the repealed portions being deleted first and the
new portion stated herein) :
Proposition No. 1
Delete the first sentence in Section 34
and insert the following as first sentence:
"At the next regular or special meeting
following the regular municipal election,
the Board of Aldermen shall meet at the
usual place for holding such meetings at
which time the first order of business
shall be the canvassing of votes and
swearin g in of new members. "

Proposition No. 2
Delete the penultimate sentence in Section 37 and insert
in the same position the following:
"Upon the passage of any ordinance prescribing a penalty
for the violation thereof, there shall be published
at least one time in the official newspaper of the City
a descriptive caption or title stating in summary the
purpose of the ordinance and the penalty for violation
thereof. "
Proposition No. 3
Delete the last two sentences in Section 68.
Proposition No. 4
Delete the entire wording of Section 139 and substitute
the following:
"Except as provided by state law now or hereafter enacted,
before the City of Wichita Falls shall become potentially
liable for damages for personal injury of any kind, or
damage to or destruction of property of any kind, the
person injured or the owner of the property damaged or
destroyed or someone in his behalf, shall give the City
notice as prescribed in the Code of Ordinances. "
SECTION 4. The propositions to amend the Charter of the City of
Wichita Falls as proposed in Section 3 of this ordinance to be sub-
mitted to the qualified voters at the regular municipal election, the
form of the official ballot, and the instructions for voting shall be
substantially as follows:
INSTRUCTIONS FOR VOTING: Place 'X' in square beside the statement
indicating the way you wish to vote.
Proposition No. 1
/7 YES PROVIDING FOR A CHANGE IN THE INSTALLATION DATE OF NEWLY
ELECTED ALDERMEN
Shall Section 34 of the City Charter be amended to provide
that newly elected aldermen shall assume office at the next
regular or special meeting of the Board of Aldermen follow-
ing the municipal election thereby removing the requirement
for a special meeting on the Monday next following the

Proposition No. 2
/ / YES PROVIDING FOR PUBLICATION OF ONLY THE SUMMARY AND PENALTY
PROVISIONS OF ORDINANCES
Shall Section 37 of the City Charter be amended to
remove the requirement that every ordinance

which prescribes a penalty for violation thereof,
be published in its entirety in the official
newspaper of the City; and substitute instead
that only the descriptive summary and the penalty

Proposition No. 3
/7 YES PROVIDING FOR A CHANGE IN THE DATE OF APPROVAL OF
THE APPROPRIATION ORDINANCE FOR EACH FISCAL YEAR
Shall Section 68 of the City Charter be amended to
allow the Board of Aldermen to pass the appropriation
ordinance before the second week of the new fiscal

/7 YES PROVIDING FOR CONFORMANCE WITH STATE LAW AND CITY
ORDINANCE REQUIREMENTS CONCERNING SUITS AND ACTIONS
AGAINST THE CITY.
Shall Section 139 of the City Charter be amended to
provide that requirements concerning suits and
actions against the City be in conformance with

The presiding judge for each precinct shall appoint not less than
two nor more than four clerks who shall assist the presiding judge and
alternate in conducting the election.
SECTION 6 . Notice of this election shall be given by publication
in a newspaper of general circulation published in the City on three
separate dates; the date of the first publication to be ten (10) days
prior to the date set for said election. The form of such notice
shall be a substantial copy of this ordinance.
