Ord 3437 3/6/1979 ORDINANCE NO. A/.37 ORDINANCE AMENDING CODE OF ORDINANCE SECTION 2-99 WHICH SETS THE RETIREMENT AGE FOR ALL EMPLOYEES OF THE CITY. WHEREAS, Federal Law has increased the mandatory retirement age for all employees except in those positions where age is a factual basis for a bona fide occupational qualification; and, WHEREAS, age is a bona fide occupational qualification for all Civil Service Employees in the Police and Fire Departments; BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Section 2-99 of the Code of Ordinance is hereby amended to read as follows: " (a) Retirement for Police and Fire Civil Service Employees shall be on the last day of the month following the month in which the employee reaches sixty-five (65) years of age. In the Police and Fire Service, there is factual basis for believing that substantially all employees above the age of sixty-five (65) years of age would be unable to perform safely and efficiently the duties of their particular jobs; thus, retirement at age sixty-five (65) is a bona fide occupational qualification for these employees. (b) Retirement for all employees of the City other than Police and Fire Civil Service Employees shall be on the last day of the month following the month in which the employee reaches seventy (70) years of age."
