Ord 3448 4/3/1979 ORDINANCE NO. s AN ORDINANCE AMENDING THE SUBDIVISION REGULATIONS OF THE CITY OF WICHITA FALLS, TEXAS, ORDINANCE NO. 2118, APPENDIX A, CODE OF ORDINANCES, ESTABLISHING BUILDING SETBACK LINES, MINIMUM REAR YARD DEPTH, AND SIDE YARD REQUIREMENTS BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Section 9, subparagraph (L) (6) of Ordinance No. 2118, Appendix A, Code of Ordinances, be amended to read as follows: "(6) Minimum setback lines. (a) Minimum building setback lines on the front street shall be required of at least twenty-five (25) feet on all residential lots. However, if there are two or more existing principal buildings on the same side of the street on the same block and fronting on such street, which have an average setback of less than 25 • feet, then the Planning Board may establish a minimum building setback line closer to the front property line, except such setback line shall not be less than twenty (20)_ feet. (b) A corner residential lot shall have a minimum building setback line on the side street of at least fifteen (15) feet. However, if there are buildings fronting on the side street in the same block on the same side of the street, which have an average setback of less than 25 feet, the Planning Board may establish an exterior side setback line for such corner lots closer to the side property line, except such setback line shall not be less than ten (10) feet. (c) Minimum building setback lines on front and side streets for other than residential lots shall be twenty-five (25) feet except where physical conditions or other factors make such setback impractical in the opinion of the Planning Board. However, the Planning Board shall not authorize a front setback line of less than fifteen (15) feet nor an exterior side setback line of less than ten (10) feet. When a reduced setback line is authorized, such determination shall take into account not only the factors presented by the owner/developer of the tract in question but also the health, safety and general welfare of the City at large. In establishing such setback lines the Planning Board shall consider, but not be limited to, the following criteria: 1. City of Wichita Falls General Plan 2. Major Thoroughfare Plan 3. Proposed use, e.g. , retail, commercial, industrial 4. Parking requirements 5. Existing right-of-way width 6. Utility and drainage easement requirements 7. Flood plain 8. Existing structures within the block 9. Height of proposed or existing structure 10. View obstruction line on corner lots In each instance where a setback line of less than twenty-five (25) feet is authorized, the Planning Board shall fully document their rationale for such deter- mination and append same to the Minutes of the meeting at which the determination was made. (d) Interior side setback line on a lot other than a residential lot shall be not less than five (5) feet when it is adjacent to a residential lot; in all other cases, lots other than residential lots shall have no minimum building setback lines on interior side lot lines and rear lot lines, and the buildings shall be located thereon with reference to the interior side lot lines and rear lot lines in any manner authorized by the Building Code. a � -2- (e) Lots in a mobile home subdivision shall have a front building setback line of not less than twenty (20) feet. (f) Corner lots in a mobile home subdivision shall have a minimum setback line of at least fifteen (15) feet on the side street." SECTION 2. Section 9, subparagraph (L) (7) of Ordinance No. 2118, Appendix A, Code of Ordinances, be amended to read as follows: "(7) Rear Yards. Minimum rear yard depths shall be required on all residential lots of at least twenty per cent (20%) of the depth of the lot. However, the depth need not exceed thirty-five (35) feet from the center line of the alley or rear utility easement. Minimum rear yard setbacks in mobile home subdivisions shall be ten (10) feet." SECTION 3. Section 9, subparagraph (L)' (8) of Ordinance No. 2118, Appendix A, Code of Ordinances, be amended to read as follows: "(8) Side Yards. Minimum side yards shall be required on all residential lots of at least five (5) feet on each side of buildings on interior lots and on the building side of corner lots." SECTION 4. Section 3, of Ordinance No. 2118, Appendix A, Code of Ordinances, be amended to add the following: "Residence. A building occupied as the dwelling place of one (1) or more persons in which the use and management of sleeping quarters, and all appliances for cooking, ventilating, heating, or lighting, are under one (1) control, and which shall include one (1) and two (2) family dwellings, apartment houses, boarding house:3 and mobile homes. Residential lot. A parcel of land described and recorded as a lot in the records of Wichita County, Texas which has or is intended to have located thereon a residential building. Such lot shall be a residential lot whether the residence is the principal or accessory building occupying or intended to occupy the lot. For the purposes of this Ordinance, a lot without a structure shall be presumed to be a residential lot in the absence of a deed restriction or similar legal action indicating otherwise."
