Ord 3450 4/11/1979I ORDINANCE NO. e/ .5 o ORDINANCE DECLARING DISASTER EMERGENCY IN THE CITY, CONTROLLING SAFETY AND SECURITY IN THE CITY BY REGULATING BEING OR REMAINING IN CERTAIN AREAS AT CERTAIN TIMES, AND PROMULGATING MAXIMUM RETAIL PRICES FOR CERTAIN GOODS AND SERVICES IN THE CITY. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. It is hereby declared that a state of disaster emer- gency exists in the City of Wichita Falls because of the tornado which struck the city on April 10, 1979. • SECTION 2. After seven o'clock p.m. , until six-thirty o'clock a.m. , no unauthorized persons will be in or remain in those areas of the city which were struck by such tornado. Unauthorized persons are all persons except people who live in such areas, their relatives, and emergency crews. SECTION 3. Because of the lack of lighting and traffic control devices in the rest of the city which was not struck by the tornado, in those areas no persons shall be on or remain on the streets/after nine o'clock p.m. • until six-thirty o'clock a.m. Any person on such streets during this period will be subject to being stopped and questioned by police 4 patrolling such areas. SECTION 4. Finding that there has been a substantial disruption of the local free, competitive market in the purchase or sale of the hereinafter described goods and services, there is hereby set as the maximum retail price for the hereinafter described goods and services, the price charged by the seller of such goods or servic es in the city p, limits of Wichita Falls on April 10, 1979 before such tornado occurred to-wit: (1) Groceries, beverages, toilet articles and ice; (2) Construction and building materials and supplies, electrical and gas generating and transmission equipment, parts and accessories; (3) Charcoal , briquettes, matches, candles, lamp illumination and heat unit-carbides, dry batteries, light bulbs, flashlights and • hand laterns; t a 1 1 4 (4) Hand tools (manual and power) , earth-moving equipment and machinery, automotive parts, supplies and accessories; (5) Apartment, duplex, multi-family dwelling, rooming house, hotel and motel rentals, insofar as such regulations are not incon- sistent with the NATIONAL HOUSING ACT, as amended, concerning federally insured housing units; (6) Gasolines, diesel oils, motor oils, kerosenes, grease and automotive lubricates; (7) Restaurant, cafeteria and boarding-house meals; (8) Medicines, pharmaceuticals, medical instruments, equipment and supplies; (9) Blankets, quilts, bedspreads, bed linens, mattresses, bed springs, bedsteads, towels and toilet paper. SECTION 5, Anyone convicted of violating this ordinance shall be subject to a fine, not exceeding $200.00. SECTION 6. This ordinance is declared to be an emergency measure because of the terrible damage done by the tornado, and it shall be- come affective upon its passage.
