Ord 3452 4/17/1979 ORDINANCE NO. 3452 AN ORDINANCE PROVIDING FOR THE TEMPORARY PLACEMENT OF MOBILE HOMES WHEREAS, a natural disaster has caused extensive damage and destruction of homes of the citizens of Wichita Falls, Texas; and, WHEREAS, subject to deed restrictions, neither waived nor suspended, there is an immediate requirement to provide temporary homes for the citizens displaced by said disaster. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Within the disaster area, temporary place- ment of a mobile home on a lot is authorized where a perma- nent residence shall be constructed or reconstructed provided the following conditions are met: a. A ninety (90) day renewable permit is obtained for the temporary placement of a mobile home. The permit shall be renewed for a maximum period of one year,includ- ing the original 90 day period,based on evidence of continuous progress toward the construction or reconstruc- of a permanent residence on the lot. b. Water, sewer, gas and electricity shall be available on the lot. c. All applicable requirements of the building, electri- cal and plumbing codes are complied with. d. This section is applicable only for those persons who were displaced by the April 10, 1979 tornado. SECTION 2. Failure to provide evidence of continuous progress toward the construction or reconstruction of a perm- anent residence shall cause the ninety (90) day renewable permit to be cancelled, in which event: a. Lot shall be brought within compliance of Section 30-2 of the Code of Ordinances, or: S. b. Mobile home shall be removed from the lot. SECTION 3. Location of mobile homes intended for perma- nent residence shall be in compliance with Chapter 30, Code of Ordinances. SECTION 4. The boundaries of the Disaster Area referred to in this ordinance are delineated on an attached map, said map being a part of this ordinance. SECTION 5. Enforcement of Chapter. It is hereby made the duty of the building inspector to enforce the provisions of the ordinance as prescribed herein or such provisions as may hereafter be enacted. SECTION 6. The fact that a natural disaster has caused extensive damage and destruction to homes and there exists an immediate requirement to provide temporary housing for the citizens displaced by said disaster, does create an urgent public necessity requiring that this ordinance be passed as an emergency measure, and this ordinance is passed as an emergency measure and shall be in force and effect immediate- ly from and after its passage.
