Ord 3457 4/17/1979 ORDINANCE NO. 5/57 ORDINANCE RETAINING THE TAXES IMPOSED BY THE LOCAL SALES AND USE TAX ACT ON THE SALE AND DISTRIBUTION OF GAS AND ELECTRICITY FOR RESIDENTIAL USE IN THE CITY, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS , TEXAS, THAT: SECTION 1. The City of Wichita Falls, Texas, a municipal corporation, by majority vote of its governing body, hereby votes to retain the taxes authorized by the Local Sales and Use Tax Act (Article 1066c, Vernon' s Texas Civil Statutes) on the receipts from the sale, production, distribution, lease, or rental of, and the use, storage, or other consump- tion of gas and electricity for residential use, as authorized by Section 6 of House Bill No. 1, Acts 1978 , 65th Legislature, Second Called Session. SECTION 2. The fact that the Board of Aldermen must enact and have effective this ordinance before May 1, 1979, and that it is essential for the City to retain the City sales tax on the sale and distribution of gas and electricity within the City of Wichita Falls, creates an emergency, therefore this ordinance shall become effective immediately upon its passage.
