Ord 3458 4/24/1979 ORDINANCE NO. 3458 ORDINANCE AMENDING ORDINANCE NO. 3452 TO AUTHORIZE TEMPORARY PLACEMENT OF MOBILE HOMES ON CERTAIN LOTS OUTSIDE THE TORNADO DISASTER AREA. WHEREAS, the extensive damage and destruction of homes in Wichita Falls by the April 10, 1979 , tornado makes it advisable and necessary to authorize temporary placement of mobile homes on certain lots outside the disaster area, to provide temporary homes for citizens displaced by the tornado. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Ordinance No. 3452 is hereby amended by adding thereto a new Section 1.1, which shall read as follows: "Section 1.1 Outside the disaster area, subject to deed restrictions, neither waived nor suspended, temporary placement of a mobile home is author- ized on a vacant lot where the mobile home is to be temporary housing and it is not intended to construct a permanent structure on the lot, provided the following conditions are met: a. A ninety day renewable permit is obtained for the temporary placement of the mobile home. The permit shall be renewable for a maximum period of one year, including the original 90 day period, based on evidence of continuous progress toward the cot$truction or reconstruction of a permenent residence at another location, or re- location to a permanent location. b. Water, sewer, gas, and electricity shall be available on the lot. c. All applicable requirements of the building, electrical and plumb- ing codes are complied with. d. The lot shall have a minimum frontage on a public street of fifty feet and minimum area of 5,000 square feet. The mobile home shall be located a minimum of twenty feet from the street right-of-way. e. This Section is applicable only for those persons who were dis- placed by the April 10, 1979 tornado." • SECTION 2. Ordinance 3452 is hereby amended by adding thereto a new Section 1.2 which shall read as follows: "Section 1.2 Outside the disaster area, subject to deed restrictions, neither waived nor suspended, temporary placement of a mobile home is author- ized on a lot where an existing residence is located and the mobile home is in- tended for the temporary residence provided the following conditions are met. a. A ninety day renewable permit is obtained for the temporary placement of a mobile home. The permit shall be renewed for a maximum period of one year based on evidence of continuous progress toward the construction of a permanent residence at another location or relocation to a permanent location. b. Water, sewer, gas and electricity shall be available on the lot. c. All applicable requirements of the building, electrical and plumb- ing codes are complied with. d. Two additional off-street parking spaces shall be provided in ad- dition to the off-street parking provided for the existing residence. e. The mobile home shall be placed behind the existing front setback of the lot. f. The total area of the existing residence and the mobile home shall not exceed forty (40) per cent of the total lot area. g. This section is applicable only for those persons who were displaced by the April 10, 1979 tornado." SECTION 3. Section 1 of Ordinance No. 3452 is hereby amended by adding subsection (e), which shall read as follows: "e. Any ordinance which requires that such mobile home be set back a certain distance from the property lines of such lot is hereby waived." SECTION 4.
