ORDINANCE GRANTING AUTHORITY TO THE CITY NATIONAL
BANK TO CONSTRUCT CANOPY OVER THE SIDEWALK, AND A
CONCRETE STOOP ON THE SIDEWALK, IN THE 800 BLOCK
OF LAMAR STREET.
WHEREAS , City National Bank is remodeling its drive-in
facilities located in its parking structure at 8th and Lamar
Streets, and it desires to construct a canopy over the side-
walk and a concrete stoop on the sidewalk at the entrance to
its Commercial Walk-up facilities on Lamar Street.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. City National Bank is hereby granted the
right and authority to construct a canopy from the Lamar
Street entrance to its Commercial Walk-up facility out to
the curb line, supported by posts; such canopy shall be
constructed in the manner as shown in the drawing attached
to Ordinance No. 3021. In addition, such Bank is hereby
granted the right and authority to construct a concrete stoop
on the sidewalk at such entrance, extending two feet eight
inches onto the City right-of-way; such concrete stoop shall
be constructed in the manner and at the location shown in
the drawings, copies of which are attached hereto, prepared
by Wingler & Sharp, Architects.
SECTION 2. Said Bank shall coordinate such project with
all utility companies whose facilities are located in the
Lamar Street right-of-way.
SECTION 3. It shall be the responsibility of the Bank
at all times to maintain said canopy and concrete stoop at
its own expense. If at any time in the future some public
use of such right-of-way makes it necessary that the canopy
and/or concrete stoop be relocated or removed, such relocation
or removal shall be done at the sole cost and expense of the
Bank.
SECTION 4. Whenever any work is being done on the
construction or maintenance of said canopy and concrete stoop,
a
the Bank shall take all necessary and proper precautions to
protect the public from damages. The Bank shall hold and
save the City of Wichita Falls harmless from all damages
or claims for damages resulting from the construction, main-
tenance and location of such canopy and concrete stoop.
SECTION 5. The right and authority hereby granted
is for so long as said canopy and concrete stoop are used
and maintained by said Bank. When the canopy and stoop
are no longer so used, they shall be removed by the Bank
at its sole cost and expense.
