ORDINANCE NO. 3472
ORDINANCE EXTENDING STATE OF DISASTER EMERGENCY
FOR SEVEN DAYS, AND EXTENDING FOR FIFTEEN DAYS
THE RETAIL PRICE CONTROLS ESTABLISHED BY ORDIN-
ANCE NO. 3450, AND REGULATING BEING OR REMAINING
IN CERTAIN AREAS AT CERTAIN TIMES.
WHEREAS, the state of emergency declared by Ordinance No. 3450
automatically terminates on May 9, 1979, by virtue of Article
5890 (e) , Revised Civil Statutes of Texas; and,
WHEREAS, the aftermath of the tornado still creates an
emergency.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Prior approval having been given by the Governor,
the state of disaster emergency in the City of Wichita Falls is
hereby extended for a period of seven days, ending May 16, 1979,
such extension being reasonably necessary to protect the health,
life and property of the City and its inhabitants.
SECTION 2. The maximum retail prices for certain goods and
s ervices, established in Section 4 of Ordinance 3450 is hereby
extended for a period of fifteen days, ending May 26, 1979. Pro-
vided, however, if there has been a bona fide increase in the
wholesale price which a retailer has had to pay for any of such
goods since April 10, 1979, which increase can be documented,
the retailer may increase the retail price of the specific goods
on which the wholesale price was increased, by a like amount. If
there has been a bona fide increase in the cost of providing any
such services since April 10, 1979, which increase can be docu-
mented, then the provider of the services may increase his price
of the specific services for which the cost has increased, by
like amount.
SECTION 3. From 12: 00 o'clock P.M. until 6: 00 o'clock A.M. ,
no unauthorized persons will be in or remain in those residential
areas of the City which were damaged by the tornado, as determined
by the Chief of Police. Unauthorized persons are all persons
except people who own property or who resided in the area on April
10, 1979, their relatives and emergency crews.

SECTION 4. Any violations of this ordinance shall subject
the offender to the penalties provided in Article 5890 (e) ,
Revised Civil Statutes of Texas.
SECTION 5. This ordinance is declared to be an emergency
ordinance, and shall become effective upon its passage.
