ORDINANCE EXTENDING STATE OF DISASTER EMERGENCY
FOR SEVEN DAYS, AND REPEALING THE RETAIL PRICE
CONTROLS ESTABLISHED BY ORDINANCE NO. 3486, AND
ESTABLISHING CONTROL OF RENTS, AND ESTABLISH-
ING THE BOARD OF ALDERMEN AS A BOARD TO HEAR
AND ALLOW ADJUSTMENTS IN THE RENTS CONTROLLED,
AND REGULATING BEING OR REMAINING IN CERTAIN
AREAS AT CERTAIN TIMES.
WHEREAS, the state of emergency declared by Ordinance
No. 3486 automatically terminates on May 30, 1979, by virtue
of Article 5890 (e) , Revised Civil Statutes of Texas; and,
WHEREAS, the aftermath of the tornado still creates
an emergency;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Prior approval having been given by the
Governor, the state of disaster emergency in the City of
Wichita Falls is hereby extended for a period of seven days,
ending June 6, 1979, such extension being reasonably nec-
essary to protect the health, life and property of the City
and its inhabitants.
SECTION 2. The maximum retail prices for certain goods
and services , established in Section 4 of Ordinance 3450 is
hereby repealed.
SECTION 3. Finding that there has been a substantial
disruption of the local, free, competitive market in the
rental of housing units, there is hereby set as the maxi-
mum rental price the price charged by the lessor or owner
in the city limits of Wichita Falls on April 10, 1979 before
such tornado occurred, to wit: Apartment, duplex, multi-
family dwelling, rooming house, hotel and motel rentals,
insofar as such regulations are not inconsistent with the
National Housing Act, as amended concerning Federally in-
sured housing units. This section shall be effective from
the date of its passage through June 12, 1979.
SECTION 4. Any person dissatisfied with the present
maximum price as set out in Section 3 of this ordinance will
be promptly afforded a public hearing and shall be permitted
to present evidence of such price, and be represented by
counsel, at said hearing before the Board of Aldermen sitting
as a Board of Adjustments. Resort to such appeal shall be
prerequisite to contest the validity of such price deter-
mination in a court of law.
SECTION 5 . From 12: 00 o'clock P.M. until 6 : 00 o'clock
A.M. no unauthorized persons will be in or remain in those
residential areas of the City which were damaged by the
tornado, as determined by the Chief of Police. Unauthor-
ized persons are all persons except people who own property
or who resided in the area on April 10, 1979, their relatives
and emergency crews.
SECTION 6. Any violations of this ordinance shall
subject the offender to the penalties provided in Article
5890 (e) , Revised Civil Statutes of Texas.
SECTION 7. This ordinance is declared to be an emer-
gency ordinance, and shall become effective upon its passage.
