ORDINANCE GRANTING AUTHORITY TO GIBSON'S
DISCOUNT CENTERS TO CONSTRUCT LOADING DOCK
ON PECAN STREET RIGHT-OF-WAY.
WHEREAS, at the present time trucks being loaded and
unloaded at Gibson's Discount Centers facility at the inter-
section of Pecan Street and Virginia Street interfere with
traffic on Pecan Street by allowing less than ten feet of
Pecan Street available for traffic; and,
WHEREAS, in order to alleviate this problem, Gibson' s
Discount Centers desires to construct a loading dock, abutting
the existing dock, which would encroach six feet on the Pecan
Street right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Gibson' s Discount Centers is hereby granted
the right and authority to construct such a loading dock
at its facility at Pecan and Virginia Streets, which loading
dock may encroach six feet on the Pecan Street right-of-way
as shown on the attached plot plan.
SECTION 2. Gibson' s Discount Centers shall coordinate
such project with all utility companies whose facilities
are located in the Pecan Street right-of-way.
SECTION 3. It shall be the responsibility of Gibson' s
Discount Centers at all times to maintain said loading dock
at its own expense. If at any time in the future some public
use of such right-of-way makes it necessary that the loading
dock be relocated or removed, such relocation or removal
shall be done at the sole cost and expense of Gibson' s Discount
Centers.
SECTION 4. Whenever any work is being done on the
construction or maintenance of said loading dock, Gibson' s
Discount Centers shall take all necessary and proper pre-
cautions to protect the public from damages. Gibson' s
Discount Centers shall hold and save the City of Wichita
Falls harmless from all damages or claims for damages resulting
from the construction, maintenance and location of such loading
dock.
SECTION 5. The right and authority hereby granted is
for so long as said loading dock is used and maintained by
Gibson' s Discount Centers. When the loading dock is no
longer so used, it shall be removed by Gibson' s Discount
Centers at its sole cost and expense.
