Ord 3529 9/4/1979 ORDINANCE NO. 2� ORDINANCE CLOSING HEARING AND FINDING CERTAIN BUILDINGS AND/OR STRUCTURES TO BE DANGEROUS; COMMANDING PROPERTY OWNERS TO REPAIR, VACATE, OR DEMOLISH SAID BUILDING AND/OR STRUCTURES WITHIN THIRTY (30) DAYS OF THE DATE OF THIS ORDINANCE AND DECLARING AN EMERGENCY. WHEREAS, the Building Inspector of the City of Wichita Falls, acting under the provisions of Article III of Chapter 7 of the Code of Ordi- nances of the City of Wichita Falls, notified in writing by certified mail the following list of property owners of the property shown that the building(s) and/or structure(s) on the premises had been classified as dangerous and that certain corrections were needed to be made or the building(s) and/or structure(s) demolished. St., Lot 23, Block 20, Scotland Addition WHEREAS, such property owners above have not complied with the directive of the Building Inspector within the sixty days allowed in said Article III; and, WHEREAS, the above listed property owners have been notified by certified mail by the Building Inspector of the time and date of Public Hearing for the above named property owners to appear before the Board of Aldermen to show cause why such building(s) or structure(s) should not be repaired, vacated, or demolished in accordance with the State of Particulars set forth in the Building Inspector's notice; and said Public Hearing was had and held at the time and place fixed therefore, to-wit, on the 4th day of September, 1979, at 8:30 A. M. in the Council Chambers in the City of Wichita Falls, Texas, and at such Public Hearing the following protests and objections were made to-wit: PROTESTED THAT PROTESTED THAT PROTESTED THAT PROTESTED THAT PROTESTED THAT PROTESTED THAT and said hearing was continued until all desiring to be heard were given full and fair opportunity to be heard and the Board of Aldermen of the City of Wichita Falls having fully considered all property matters, is of the opinion that the said hearing should be closed. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: Said hearing be and the same is hereby closed, and the said protests and objections, and any and all other protest objections whether enum- erated or not, be and the same are hereby, overruled. From the evidence presented in the aforementioned Public Hearing by property owners appearing and the Building Inspector of the City of Wichita Falls, the building(s) and/or structure(s) at the location listed above with the corresponding property owner is found to be a dangerous building as defined in said Article III and the property owners listed or any other person having an interest in said building as shown by the tax records of the City of Wichita Falls, are hereby commanded to repair, vacate, or demolish the building(s) and/or structure(s) in accordance with the State of Particulars set forth in the Building Inspector's notice. The property owner listed or any other person having an interest in said building(s) and/or structure(s) as shown by the tax records of the City of Wichita Falls is further commanded to repair, vacate or demolish in accordance with the State of Particulars .set forth in the Building Inspector's notice within thirty (30) days from the date of this ordinance. If, within thirty (30) days from the date of this ordinance, any such building(s) and/or structure(s) have not been repaired or demolished, it shall be demolished or removed at the expense of the City by the City or its con- tractor, and the net cost for demolition or removal shall be charged to the owners of the property and assessed on the land on which the building(s) and/or structure(s) stood. The fact that the repair, vacation and/or demolition of dangerous building(s)and/or structure(s) is being delayed pending the taking effect of this ordinance creates an emergency for the immediate preservation of the public busi- ness place, property, health, safety and general welfare of the public which re- quires that this ordinance shall become effective from and after the date of its passage and is accordingly so ordained.
