RELEASING EASEMENT FOR SANITARY SEWER
LINE ON 5. 89 ACRES TRACT OF LAND OUT OF BLOCKS
33 AND 34, J. HIRHCHI SUBDIVISION OF THE DAVID
WELCH SURVEY, A-324.
WHEREAS , on October 31, 1959, Mrs. L. E. (Laura) Ruehl
and husband, H. L. Ruehl conveyed an easement for a sanitary
sewer line across part of Block 33, Hirschi Subdivision, to
Wichita County Water Control and Improvement District No. 4,
which easement is recorded in Volume 809, Page 626, Wichita
County Deed Records; and,
WHEREAS, on October 27 , 1959, C. L. Swafford and wife,
Nola Faye Swafford conveyed an easement for a sanitary sewer
line across part of Block 34, Hirschi Subdivision, to Wichita
County Water Control and Improvement District No. 4, which
easement is recorded in Volume 810, Page 53 , Wichita County
Deed Records; and,
WHEREAS, thereafter a sanitary sewer line was built
across said two tracts of land, and the City of Wichita Falls
is now the owner of the easements and the sanitary sewer line,
which are not located on those parts of Block 33 and Block
34 which comprise the 5. 89 acres hereinafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS, THAT:
The two easements for sanitary sewer main described
above are hereby released insofar, and only insofar, as they
cover the following described tract of land in Wichita County,
Texas, to-wit:
5. 89 acres of land out of Blocks 33 and 34
of the J. Hirschi Subd. of the David Welch
Sur. .A-324, Wichita County, Texas; described
by metes and bounds as follows:
BEGINNING at an iron stake set at the N.W.
Cor. of this tract in the North line of said
Block 33. The N.W. Cor. of said Block 33 brs.
N. 79°44 'W. 346. 8 ft.
THENCE S. 79°44 'E. , with a fence, along said
North line of Block 33, 562. 5 ft. to a fence
Cor. post for the N.E. Cor. of said Block 33.
THENCE South, with a fence, along the East
line of said Block 33, 229.7 ft. to a fence
Cor. post in the West R.O.W. line of Loop 11.
THENCE with a fence along a curve along said
R.O.W. line whose central angle is 57°38 ' and
whose radius is 1492. 4 ft. , at 15. 0 ft. pass
fence Cor. post on common line between Blocks
33 and 34, at 294. 5 ft. fence post for the
S.E. Cor. of this tract.
THENCE N. 79°44'W. , with a fence along the
South line of said Block 34, 430. 0 ft. , to
an iron stake set at a fence Cor. post for
the S.W. Cor. of this tract.
THENCE N. 10°43 'E. 239. 3 ft. iron stake for Cor.
THENCE N. 04°25'E. 240. 3 ft. to the place of
beginning and containing 5. 89 acres of land./
