ORDINANCE CLOSING HEARING AND FINDING CERTAIN
STORM DAMAGED PROPERTIES TO BE DANGEROUS;
COMMANDING PROPERTY OWNERS TO REMOVE ALL HEALTH
AND SAFETY HAZARDS WITHIN THIRTY (30) DAYS OF
THE DATE OF THIS ORDINANCE AND DECLARING AN
EMERGENCY.
WHEREAS, the Chief Housing Code Enforcement Officer of the City
of Wichita Fails, acting under the provisions of Section IV, Subsection (e), of
Ordinance No. 2388 as amended by Ordinance No. 3011, of the Code of Ordinances
of the City of Wichita Falls, notified in writing by certified mail the following
list of property owners of the property shown that the property had been classified
as dangerous and that the removal of all health and safety hazards was needed.

WHEREAS, such property owners above have not complied with the
directive of the Chief Housing Code Enforcement Officer within the time allowed
in said Ordinance No. 2388; and,
WHEREAS, the above listed property owners have been notified by
certified mail by the Chief Housing Code Enforcement Officer of the time and
date of Public Hearing for the above named property owners to appear before the
Board of Aldermen to show cause why all health and safety hazards had not been
removed on such property in accordance with the State of Particulars set forth in
the Chief Housing Code Enforcement Officer's notice; and said Public Hearing was
had and held at the time and place fixed therefore, to-wit, on the 6th day of
November, 1979, at 8:30 A. M. in the Council Chambers in the City of Wichita Falls,
Texas, and at such Public Hearing the following protests and objections were made
to wit:

and said hearing was continued until all desiring to be heard were given full
and fair opportunity to be heard and the Board of Aldermen of the City of Wichita
Falls having fully considered all property matters, is of the opinion that the
said hearing should be closed.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF WICHITA FALLS, TEXAS:
Said hearing be and the same is hereby closed, and the said
protests and objections, and any and all other protest and objections whether
enumerated or not, be and the same are hereby, overruled.
From the evidence presented in the aforementioned Public Hearing
by property owners appearing and the Chief Housing Code Enforcement Officer of
the City of Wichita Falls, the property at the location listed above with the
corresponding property owner is found to be dangerous as defined in said Ordin-
ance No. 2388 and the property owners listed or any other person having an inter-
est in said property as shown by the tax records of the City of Wichita Falls, are
hereby commanded to remove all health and safety hazards in accordance with the
State of Particulars set forth in the Chief Housing Code Enforcement Officer's
notice. The property owner listed or any other person having as interest in said
property as shown by the tax records of the City of Wichita Falls is further com-
manded to remove all health and safety hazards in accordance with the State of
Particulars set forth in the Chief Housing Code Enforcement Officer's notice with-
in thirty (30) days from the date of this ordinance.
If, within 30 days from the date of this ordinance, any health '
and safety hazards have not been removed, they shall be removed at the expense of
the City by the City or its contractor, and the net cost of removal shall be
charged to the owners of the property and assessed on the land on which the health
and safety hazards existed.
The fact that the removal of all health and safety hazards is
being delayed pending the taking effect of this ordinance creates an emergency
for the immediate preservation of the public business place, property, health,
safety and general welfare of the public which requires that this ordinance shall
become effective from and after the date of its passage and is accordingly so or-
dained
