AN ORDINANCE CLOSING AND ABANDONING A PORTION OF MCGAHA AVENUE
BETWEEN LOT 12, BLOCK 68 AND LOT 1, BLOCK 69 IN FAITH VILLAGE,
UNIT II, AND RETAINING A FIFTEEN (15) FOOT UTILITY EASEMENT.
WHEREAS, the Planning Board has recommended the closure of said
street and the retaining of said utility easement; and
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas
deems it advisable and in the public interest to close this street.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS THAT:
SECTION 1. That portion of McGaha Avenue lying between Lot 12,
Block 68 and Lot 1, Block 69 in Faith Village, Unit II and lying north of the
north right-of-way line of Featherston Avenue be and the same is hereby closed
and abandoned.
SECTION 2. The City of Wichita Falls, Texas, hereby reserves an
easment in a portion of said land for the purpose of laying and maintaining
all kind and character of utility lines including water, gas, electric, telephone
and power lines, sanitary and storm sewers and drainage ditches; no structures
shall be built by the landowner on said easement; such easement is more fully
described as follows:
A fifteen (15) foot utility easement parallel and adjacent to the east
property line of Lot 12, Block 68, Faith Village, Unit II and lying
south of a five (5) foot alley and north of the north right-of-way
line of Featherston Avenue.
