Ord 3569 12/4/1979 ORDINANCE NO. 3569 AN ORDINANCE EXTENDING THE CITY LIMITS OF THE CITY OF WICHITA W CH TA FALLS, TEXAS, BY ANNEXING CERTAIN LANDS ADJACENT TO THE TERRI- TORIAL LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, WHICH LANDS ARE DESCRIBED IN THIS ORDINANCE. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That the following tracts of land located in Wichita County, Clay County, and Archer County, Texas, be and the same are hereby ordered to be annexed and to be included within the corporate limits of the City of Wichita Falls, Texas, and the corporate limits be extended so as to include said tracts of land in Wichita County, Texas, the same being more particularly described as follows: TRACT I BEING a tract of land out of the H.&G.N. Railroad Company Survey, Section 39, A-161; Ramon Travino Survey, Section 1 and 4, A-286; and Thomas Curry Survey, A-345, Wichita County, Texas; said tract being more specifically described by metes and bounds as follows: BEGINNING at an iron rod in the south right-of-way of Hemme Road, said rod being S 00°26'30"E 30.0 feet and S 89°41'W 1237.5 feet from the northeast corner of said Section 39, A-161, Wichita County, Texas; THENCE S 00°26'30"E, at 2.5 feet passing fence corner and continuing with fence, in all, 2439.1 feet to an iron rod at fence corner for the southeast corner of this tract; THENCE with fence S 89°45'W, 3165.4 feet to an iron rod at a fence corner in the east right-of-way of Central Freeway North, said iron rod being on a curve to the right having a radius of 5729.58 feet and whose center bears N 70°09'49"E; THENCE continuing S 89°45'W, 370 feet to the west right-of-way line of Central Freeway North to a point for corner, said point also being the southwest corner of the tract; THENCE along west right-of-way line of Central Freeway North, N 15°46' W, 2790 feet for corner; THENCE N 74°45'E, 390 feet to a point on the east right-of-way line of Central Freeway North; THENCE S 80°46'E, 740 feet to a point, said point also being 200 feet north of the north right-of-way line of Hemme Road measured at right angles to said right-of-way; THENCE continuing parallel to the said right-of-way in an easterly direction and 200 feet from the north right-of-way line of Hemme Road, N 89°42'E, 3200 feet to a point for corner, said point also being the northeast corner of this tract; THENCE S 00°26'30"E, 260 feet to the place of beginning, containing 241 acres more or less. TRACT II BEING a tract of land out of the Cherokee County School Land, A-33 Kemp & Newby Subdivision, Blocks 1 & 3; G. Reynolds Survey, A-251 and J.R. McDowell Survey, A-194, Wichita County, Texas; more specifically described by metes and bounds as follows: BEGINNING at the point of intersection of the west right-of-way line of Old Jacksboro Highway and the present city limits as described in Ordinance No. 1866; I. -2- THENCE in a southeasterly direction along the west right-of-way line of Old Jacksboro Highway, S 13°26' E,3020 feet to a point for corner, said point also being 225 feet south of the center line of Rathgeber Road right-of-way measured at right angles to said right-of-way; THENCE in a westerly direction parallel to the centerline of Rath- geber Road right-of-way, at a distance of 225 feet measured at right angles to the said centerline, N 89°08'W, 2865 feet to a point for corner, said point also being on the west right-of-way line of Crest- view Memorial Road; THENCE along the west right-of-way line of Crestview Memorial Road, 200 feet to a point for corner, said point also being on the south right-of-way line of Rathgeber Road; THENCE along the south right-of-way line of Rathgeber Road, N 89°08' W, 1525 feet to a point for corner, said point also being the point of intersection of the present city limits line as described in Ordinance No. 2598 extended southwesterly 37 feet and said south right-of-way line; THENCE in a northeasterly direction N 47005'E, 37 feet to a point, said point also being on the present city limits line as described in Ordinance No. 2598; THENCE continuing in a northeasterly direction along the said city limits as described in Ordinance No. 2598, N 47°05'E, 3188 feet to a point and N 52°26'E, 719 feet to a point for corner, said point also being on the present city limits line as described by Ordinance No. 1866; THENCE east, 700 feet along the present city limits line as described by Ordinance No. 1866 and containing 219 acres more or less. TRACT III BEING a tract of land out of the Denton County School Lands, League 2, A-57, Block 2; and William Meyer Survey, Kemp Subdivision, Blocks 9 & 10, Wichita County, Texas; more specifically described by metes and bounds as follows: BEGINNING at a point on the east right-of-way line of Allendale Road, said point also being 200 feet south of the south right-of-way line of Kell Freeway; THENCE along the east right-of-way line of said Allendale Road as follows: S 00°12'E, 186 feet to a point of curvature; THENCE along a curve to the left having a radius of 3759.72 feet and central angle of 4°57' for a distance of 299.5 feet; THENCE S 05°09'E, 221.27 feet to a point of curvature; THENCE along a curve to the right having a radius of 3879.72 feet and central angle of 6 00' for a distance of 406.28 feet; THENCE S 00°51'W, 952.39 feet to a point of curvature; THENCE along a curve to the right having a radius of 3879.72 feet and central angle of 8°00' for a distance of 541.71 feet; THENCE S 08°51'W, 39.90 feet to a point of curvature; THENCE along a curve to the left having a radius of 3759.72 feet and central angle of 8°00' for a distance of 524.95' . THENCE S 00°51'W, 90 feet to a point for corner on the east right-of- way line of Allendale Road, said point being the intersection of the said right-of-way line and the city limits as described in Ordinance 3149; THENCE N 89°14'09"W, 50.63 feet to a point for corner, said point also being the point of intersection of the city limits line described by Ordinance No. 3149 and Ordinance No. 1910; • 'a . -3- THENCE in a northerly direction along the present city limits line as described by Ordinance No. 1910, N 00°51'E, 3292 feet to a point for corner; THENCE in an easterly direction along the present city limits line as described by Ordinance No. 2756, east, 80 feet to the point of begin- ning, containing 7 acres more or less. SECTION 2. In conformity with Section 6 of Article 970a of the Revised Civil Statutes of Texas, before these annexation proceedings were instituted, the Board of Aldermen called a public hearing on October 16, 1979 to provide an opportunity for all interested persons to be heard; notice of such hearing was published once in the Wichita Falls Record News not more than twenty (20) days nor less than ten (10) days prior to the public hearing. Such public hearing was held on November 6, 1979 which was not more than twenty (20) days nor less than ten (10) days prior to the institution of the annexation proceedings. SECTION 3. In conformity with Section 3-A of the amended Charter of the City of Wichita Falls, Texas, this ordinance is on the 20th day of November, 1979 introduced and the City Clerk is directed to publish said ordinance one (1) time in a newspaper of general circulation published in the City of Wichita Falls, Texas, and seven (7) days thereafter this ordinance may be finally acted upon. SECTION 4. The fact that this is an urbanizing area, and City safety, health and police controls and measures will be needed, creates an emergency, and it is hereby declared that this ordinance is an emergency measure on the grounds of public need for the preservation of the peace, health, and safety of property of the city, and this ordinance shall go into effect immediately upon its passage.
