ORDINANCE GRANTING AUTHORITY TO JOE PISTOCCO
PONTIAC-CADILLAC, INC. , TO CONSTRUCT A BRICK
LEDGE ON AUSTIN STREET RIGHT-OF-WAY ABUTTING
BLOCK 148 OF THE ORIGINAL TOWN OF WICHITA FALLS.
WHEREAS, Joe Pistocco Pontiac-Cadillac, Inc. , desires
to construct a brick foundation and wall adjacent to part of
their building which is located on Block 148 of the
Original Town of Wichita Falls; the existing building is
built on the property line of Austin Street, and the proposed
construction would encroach on Austin Street right-of-way
approximately four to six inches; and,
WHEREAS, such corporation has requested authority from
the Board of Aldermen to so construct such foundation and
wall.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Joe Pistocco Pontiac-Cadillac, Inc. , is hereby
granted the right and authority to construct such brick
foundation and wall on the right-of-way of Austin Street
adjacent to their building on Block 148 of the Original Town
of Wichita Falls, such construction to encroach on such
right-of-way approximately four to six inches. Such brick
foundation and wall will begin 54 feet from the corner of
Seventh and Austin Streets, and extend 144 feet north to the
offset in the building.
SECTION 2. Such corporation shall coordinate such
construction with all utility companies whose facilities
are located in the street right-of-way.
SECTION 3. It shall be the responsibility of such
corporation at all times to maintain said brick foundation
and wall at its own expense. If at any time in the future
some public use of such street makes it necessary that the
brick foundation and wall be removed, such removal shall be
done at the sole cost and expense of such corporation.
SECTION 4 . Whenever any work is being done on such brick
foundation and wall, the corporation shall take all necessary
and proper precauta„ons to protect the public from damages.
Such corporation shall hold and save the City of Wichita Falls
harmless from all damages or claim for damages resulting from
the construction, maintenance and location of such brick
foundation and wall.
SECTION 5. The right and authority hereby granted is
for so long as said brick foundation and wall are used and
maintained by said corporation, unless the City orders them
removed at earlier date, as provided in Section 3. When
the brick foundation and wall are no longer so used, they
shall be removed by such corporation at its sole costs and
expense.
