ORDINANCE AMENDING SECTION 29-29 OF THE CODE
OF ORDINANCES; AUTHORIZING THE POLICE DEPART-
MENT OR MEMBERS THEREOF TO IMPOUND CERTAIN VEHICLES;
PROVIDING NOTICE TO BE GIVEN TO THE REGISTERED
OWNER BY MAIL IF POSSIBLE OR BY PUBLICATION; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
That Section 29-29 of the Code of Ordinances be amended to
read as follows :
SECTION 1. "The Chief of Police or his duly authorized
agent or representative is hereby authorized to remove a vehicle
from a street or highway or private property to the nearest
garage or other place of safety, or to a garage designated or
maintained by the police department, or otherwise maintained
by this City under the circumstances hereinafter enumerated:
(1) When any vehicle is left unattended upon
any bridge, viaduct, or causeway, or in
any tube or tunnel where such vehicle
constitutes an obstruction to traffic.
(2) When a vehicle upon a highway is so disabled
as to constitute an obstruction to traffic
and the person or persons in charge of the
vehicle are by reason of physical injury
incapacitated to such an extent as to be
unable to provide for its custody or removal.
(3) When any vehicle is left unattended upon
a street and is so parked illegally as to
constitute a definite hazard or obstruction
to the normal movement of traffic.
(4) When a motor vehicle is inoperable and over
eight years old and is left unattended on
public property for more than 48 hours.
(5) When a motor vehicle has remained illegally
on public property for a period of more
than 48 hours.
(6) When a motor vehicle has remained on
private property without the consent of
the owner or person in control of the
property for more than 48 hours.
(7) When any vehicle is left unattended in
a properly designated fire lane or
fire zone which is marked by signs
designating same as a fire lane or fire
zone.
(8) When the driver of a vehicle is arrested
and is incapacitated to the extent that
he is unable to arrange for the dispos-
ition of the vehicle.
(b) A police department or member thereof that takes
into custody an abandoned motor vehicle shall notify within
10 days thereof, by registered or certified mail, return
receipt requested, the last known registered owner of the
motor vehicle and all lien holders of record pursuant to
the Certificate of Title Act, as amended (Article 6687-1,
V.A.T.S. ) , that the vehicle has been taken into custody. The
notice shall describe the year, make, model and vehicle
identification number of the abandoned motor vehicle, set
forth the location of the facility where the motor vehicle
is being held, inform the owner and any lien holders of their
right to reclaim the motor vehicle within 20 days after the
date of the notice upon payment of all towing, preservation,
and storage charges resulting from placing the vehicle in
custody, or garagekeeper':s charges if notice is pursuant to
the provisions dealing with garagekeepers and abandoned
vehicles. Further, the said notice shall state that the
failure of the owner or lien holders to exercise their right

to reclaim the vehicle within the time provided shall be deemed
a waiver by the owner and all lien holders of all right, title,
and interest in the vehicle and their consent to the sale of
the abandoned motor vehicle at a public auction.
(c) If the identity of the last registered owner cannot
be determined, or if the registration contains no address for
the owner; or if it is impossible to determine with reasonable
certainty the identity and addresses of all lien holders, notice
by one publication in one newspaper of general circulation in
the area where the motor vehicle was abandoned shall be sufficient
to meet all requirements of notice pursuant to this Article.
Such notice by publication can contain multiple listings of
abandoned vehicles. Any such notice shall be within the time
requirements prescribed for notice by registered or certified
mail and shall have the same contents required for a notice
by registered or certified mail. "
SECTION 2 . The necessity for maintaining the streets
and highways free of obstructions for the public and to provide
for the health and safety of the public at large gives rise to
an emergency and for such reason, this ordinance is declared
to be an emergency measure, effective the date of passage.
