ORDINANCE NO.
AN ORDINANCE CREATING A COMMISSION TO BE
KNOWN AS THE CLEAN COMMUNITY COMMISSION FOR
THE PURPOSE OF REDUCING LITTER IN THE CITY;
PROVIDING FOR THE DISCHARGtE OF MEMBERS;
PROVIDING FOR THE ORGANIZATION AND TERM OF
MEMBERS; PROVIDING FOR A QUORUM: PROVIDING
FOR GENERAL POWERS: PROVIDING FOR RULES,
REGULATIONS AND BYLAWS; PROVIDING FOR FUNDING;
AND PROVIDING FOR THE DURATION OF THE COMMISSION
AND A METHOD OF TERMINATION.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS:
SECTION 1: There is hereby created a commission to be known as the
Clean Community Commission which shall analyze the relative cleanliness of
all areas of the City, enforcement practices, and other physical and situa-
tional factors involved in litter and solid waste collection and disposal.
(a) The Commission shall be composed of fifteen residents of the City
of Wichita Falls who shall be appointed by the Board of Aldermen to serve with-
out compensation. Of the Commission members first appointed, seven shall be
appointed to serve terms ending December 31, 1981, and eight to serve terms
ending December 31, 1982. Thereafter, all appointments shall be for terms of
two years.
(b) To assist the Commission, there shall also be three ex officio or
non-voting members, one of whom shall be the City Manager or his designee, the
second shall be the Director of Public Works or his designee, and the third
shall be the Community Information Specialist.

(c) Should any member of the Commission fail to serve
his full term for any reason, the Board of Aldermen shall
appoint a person to fill the unexpired term. The Board of
Aldermen of the City of Wichita Falls, Texas may terminate
or discharge any of the members of the Clean Community
Commission with or without cause. The Board of Aldermen shall
appoint a person to fill the unexpired term.
(d) Immediately upon the appointment of the members of
the Commission, they shall meet for organizational purposes.
They shall elect one person from their number to act as
chairman, one person to act as vice-chairman, and one person
as secretary. The chairman and vice-chairman shall serve for
a term of one year, and annually thereafter the members shall
elect a chairman and vice-chairman from the membership of the
Commission.
(e) Eight members of this Commission shall constitute a
quorum. All questions shall be decided upon by a majority
vote of the members present. In event of a tie vote on any
matter coming before the Commission, the chairman shall cast
a vote.
(f) The Clean Community Commission is an official
Commission of the City of Wichita Falls, Texas with the power
to recommend to the Board of Aldermen actions which require
official City support. The Clean Community Commission
shall serve as an advisory body for any litter and related

ordinances. The Commission will develop programs to identify
the needs of the City which result from litter and solid waste,
to make these needs known through public education and infor-
mation and to develop a systematic approach to correcting
problems as they are identified.
(g) The Clean Community Commission may propose such
bylaws and rules governing its functions as it deems best;
provided, however, that such rules and bylaws shall not be
in conflict with the Constitution and Statutes of the
State of Texas or the charter and ordinances of the City of
Wichita Falls, Texas. The proposed bylaws and rules shall
not be effective unless and until approved by the Board of
Aldermen.
(h) The Clean Community Commission is authorized to
receive contributions and grants of funds from private and
governmental sources; which contributions shall be paid to
the City and kept separate and apart and used to further the
goals of the Commission.
(i) The Clean Community Commission shall continue in
operation perpetually unless it is terminated by the Board of
Aldermen.
SECTION 2 . No member shall serve on the Commission more
than three consecutive terms.
SECTION 3. It is further provided that in case a section,
clause, sentence or part of this ordinance shall be deemed or
adjudged by a court of cor. etent jurisdiction to he invalid,
then such invalidity shall not affect, impair or invalidate the
remainder of this ordinance.
