ORDINANCE AMENDING SECTION 18-48 (a) OF THE CODE
OF ORDINANCES, REQUIRING A NOTICE TO BE GIVEN,
RESULTS FROM FAILURE TO ABATE, AND SETTING A
SCHEDULE OF COSTS FOR ABATEMENT
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1. Section 18-48 (a) of the Code of Ordinances is hereby
amended to read as follows:
"(a) Whenever the existence of any such nusiance, as defined in Section
18-47, on any lot or parcel of real estate situated in the City shall come
to the knowledge of the City Health Officer or his assistants, it shall be his
duty, and he shall cause a written notice identifying such property to be issued
forthwith to the person owning or having possession or control of same requiring
the abatement of such nusiance by grubbing and removing such weeds, brush, rubbish
or other objectionable, unsightly or unsanitary matter of whatever nature, as the
case may be. Such notice shall also state that default of abatement by him with-
in ten (10) days from the date of such notice, the City may cause the same to be
done and pay therefore, and charge the cost and expense incurred in having such
work done for improvements made to the owner of such property. If such costs and
expenses are unpaid, the City shall have right to fix a lien or file suit seeking
payment in a court of competent jurisdiction."
SECTION 2. Section 18-48 of the Code of Ordinances is hereby amended to
include paragraph "c" below:
"(c)" The cost of work done or improvements made in abating such nusiance
shall, when performed by the City, be as follows:
(1) For mowing by City (one large mower and one employee) per hour to
the next 4 hour; $10.50 per hour.
(2) For cleanup by City (two employees and one truck) per hour to the
next 4 hour; $20.50 per hour.
(3) For combined mowing and clean-up, per hour to the next
hour; $31. 00 per hour.
(4) Additional charges
Tractor with sickle mower $16. 00/hr
Tractor with 60" mower 16. 00/hr
Small Mower 6. 00/hr
• Dump truck hauling 17. 50/hr
Labor (per employee) 5. 00/hr
Loader use 17. 50/hr
SECTION 3. Section 18-48 of the Code of Ordinances, is
hereby amended to include paragraph "d" below:
" (d) The cost of work done or improvements made in
nuisance shall, when performed by private ,
independent contractors, be the actual cost
to the City and an administrative fee of $4 . 00
per lot or parcel of land. Cost of the work
• done or improvements made in abating such
nuisance shall , when performed by the City,
be the charges listed in "c" above and an
administrative fee of $4. 00 per lot or parcel
of land.
