AN ORDINANCE ABANDONING THE CONSTRUCTION OF IMPROVEMENTS
OF PORTIONS OF STREETS AT LOCATIONS OUT OF THE 1980 COM-
MUNITY DEVELOPMENT ASSESSMENT PAVING PROGRAM, DELETING
SAME FROM CONTRACT WITH TIMMINS-ANDERSON CORPORATION
WICHITA FALLS, TEXAS; AN CANCELING THE ASSESSMENT LIENS
LEVIED AGAINST ABUTTING PROPERTIES.
WHEREAS, by Ordinance 3628 dated March 11, 1980 the Board of Aldermen of the
City of Wichita Falls, Texas, a municipal corporation, determined the necessity
of paving and constructing other improvements on portions of streets designated
as a portion of the 1980 Community Development Assessment Paving Program in
Wichita Falls, and a notice of such action, in accordance with Article 1220A
of Revised Civil Statutes of Texas, was filed with the County Clerk and was
recorded in Volume 1288, Page 898 of the Deed of Trust Records of Wichita County,
Texas; and,
WHEREAS, by Ordinance 3687 dated June 24, 1980, the Board of Aldermen of the City
of Wichita Falls," Texas, adopted the plans and specifications and authorized for
the. advertisement for bids; and,
WHEREAS, there is insufficient benefit versus the total cost of the paving.
WHEREAS, Timmins-Anderson Corporation, Wichita Falls, Texas, who has contracted
with the City for the construction of said improvements, has consented to the
abandonment of the improvements on such portion of streets.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE .CITY OF WICHITA
FALLS, TEXAS, THAT:
I.
The improvements on the following portions of streets shall be abandoned, and
same shall be deleted from the contract with Timmins-Anderson Corporation, Wichita
Falls, Texas, and the assessment liens heretofore levied against properties abutt-
ing such portions of streets are hereby cancelled, to wit:
EAST SECOND From the east property line of Live Oak
STREET: Street to the east property line of Pine Street.
MAPLE From the north property line of East Second
STREET: Street to 350 feet north of the north property
line of East Second Street.
The City Clerk is hereby directed to file a notice of this ordinance with the
County Clerk of Wichita County, Texas, for the purpose of releasing the assess-
ment liens against such properties abutting the portions of streets set out above.

NOTICE OF RELEASE OF ASSESSMENT
THE STATE OF TEXAS
COUNTY OF WICHITA
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas a municipal
corporation, has heretofore ordered an assessment against certain property abutt-
ing the list of streets listed below; and,
WHEREAS, notices of said assessment were dated June 24, 1980 and recorded in
Volume 1288, Page 898 of the Deed of Trust Records of Wichita County, Texas, to
which reference is here made for all purposes; and,
WHEREAS, by Ordinance No. cAlY dated February 17, 1981 the Board of Alder-
men released such assessments against the properties abutting the following portions
of streets, to-wit:
EAST SECOND From the east property line of Live
STREET: Oak Street to the east property line
of Pine Street.
MAPLE From the north property line of East
STREET: Second Street to 350 feet north of the
north property line of East Second St.
NOW, THEREFORE, notice is hereby given that such assessment liens levied against
the properties abutting on the above set out portions of streets have been canceled.
