ORDINANCE NO. 177/
ORDINANCE GRANTING WAIVER OF SECTION 2202 . 1
OF THE BUILDING CODE TO ALLOW THE NEW
FACADE ON STALEY BUILDING TO PROJECT OVER
THE STREET RIGHT-OF-WAY.
WHEREAS, the owners of the Staley Building located on
Lot 1, Block 175 of the Original Townsite of Wichita Falls,
are preparing to renovate the building, including the
construction of a new facade which will extend into and
project over the street right-of-way in excess of the six
inches allowed by Section 2202. 1 of the Building Code; and,
WHEREAS, Killebrew/Rucker/Associates, Inc. have requested,
for the owner, that the City waive such requirements of
Section 2202 . 1 of the Building Code to allow such projection;
and,
WHEREAS, the Board of Aldermen find that the circumstances
involved in this situation are exceptional , and that a waiver
of such provision should be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS , THAT:
SECTION 1. The requirements of Section 2202 . 1 of the
Building Code are hereby waived to allow the owners of the
Staley Building situated on Lot 1, Block 175 , Original Townsite,
to construct a new facade on such building which will extend
into and project over the street right-of-way by the distances
as shown on the Staley Building plot plan, prepared by Biggs &
Mathews , Inc. under date of December 19 , 1980 and by Killebrew/
Rucker/Associates , Inc. , under date of January 9 , 1980 , a
copy of which plot plan is attached hereto.
SECTION 2 . Whenever any work is being done on the
construction or maintenance of said facade, the owners of
such building shall take all necessary and proper precautions
to protect the public from damages. Such owners shall hold
and save the City of Wichita Falls harmless from all damages
or claim for damages resulting from the construction, maintenance
and location of such facade.
SECTION 3. The right and authority hereby granted is
for so long as said facade is used and maintained by the
owners.
