. ORDINANCE AMENDING ORDINANCE 3758
, SECTION 5 AND ALLOWING, UNDER CERTAIN
CONDITIONS, PARTIAL WAIVER OF REQUIREMENTS
FOR ENCLOSURE PROVIDING FOR RECISION OF
THE WAIVER, AND PROVIDING FOR APPEAL OF
DECISIONS.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. That the second sentence in Section 5 of
Ordinance 3758 is hereby amended to read as follows:
"If the owners from land located
within 300 feet of applicant' s
location wish to speak, the Commission
will hear said owner. Commission shall
also hear from applicants and other
citizens if they wish to speak. "
SECTION 2 . That Ordinance 3758 be amended to include a
Section 5. 1 which shall read as follows :
"The Commission may, if requested at the
time of application, also hold a hearing
on applicant' s request to waive a portion
of the fencing requirements of Section 9,

of this ordinance. The Commission has the
authority to waive the screening require-
ment only when man-made or natural terrain
exists which would provide or make unnecessary
any further screening at that point. Prior
to granting a waiver, the Commission shall
find either that the waiver will not allow
applicant' s location to be reasonably viewed
from an alley, street or highway or that
other similar structures that block vision
are present along the portion of the applicant' s
location where the waiver is to be granted. 4
The Commission reserves the right to
rescind any waiver previously granted should,
for any reason, the man-made or natural
features considered when granting a waiver
be removed or altered. Should the applicant
wish to appeal the Commission' s decision
regarding the waiver of the fencing require-
ments or the recision of any waiver, the

-.applicant must request a review within
ten (10) working days in writing to the
City Clerk. The review of the decision
shall be made by the City Manager or
Assistant City Manager, either of whom
shall have the authority to uphold,
reverse, or modify the decision of
the Commission. The decision of the City
Manager or Assistant City Manager shall
be final. "
