AN ORDINANCE CLOSING AND ABANDONING A PORTION OF
FOURTH STREET AND CERTAIN ALLEYS IN THE BEAN AND
STONE RESUBDIVISION OF BLOCK 240 AND BLOCK 241 OF
THE ORIGINAL TOWNSITE OF WICHITA FALLS, TEXAS
WHEREAS, the owner of Block 240 and that portion of Block 241 which
lies south of the south right-of-way line of the east-west twenty-five (25) foot
alley, Bean and Stone Resubdivision of Blocks 240 and 241 of the Original Townsite
of Wichita Falls has requested that the portion of Fourth Street, which lies
between said blocks; and certain alleys lying within said blocks be closed and
abandoned; and,
WHEREAS, the Planning Board of the City of Wichita Falls has recommended
to the Board of Aldermen that said streets and alleys be closed and abandoned; and,
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas deems
it advisable and in the public interest to close the street and alleys hereinafter
described.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. That portion of Fourth Street lying between Block 240 and
Block 241, Bean and Stone Resubdivision of the Original Townsite of Wichita Falls
east of the east right-of-way line of Broad Street and west of the west right-of-way
line of Bluff Street , be and the same is hereby closed and abandoned.
SECTION 2. All alleys located in the Bean and Stone Resurvey of Block
240 of the Original To msite of Wichita Falls , be and the same are hereby closed
and abandoned.
SECTION 3. That portion of north-south twenty-five (25) foot alley
located in the Bean and Stone Resubdivision of Block 241 of the Original Townsite
of Wichita Falls which lies between lots 15 and 16 and south of the south right-
of-way line of the east-west twenty-five (25) foot alley in said block, be and
the same is hereby closed and abandoned. Page 3 of 4 Pages

SECTION 4. This ordinance shall not become effective until such time
as:
(a) Third Street between Broad and Bluff Streets is paved or acceptable
traffic circulation is provided as required by the Directors of Public Works and
Traffic and Transportation.
(b) Block 240 and that portion of Block 241 which lies south of the
south right-of-way line of the east-west twenty-five (25) foot alley, Bean and
Stone Resubdivision of Blocks 240 and 241 of the Original Townsite of Wichita
Falls are replatted into one lot;
(c) The utility lines located in such street and alleys have been
relocated or easements for such utility lines have been dedicated;
(d) Such replat is filed for record with the Wichita County Clerk.
Further, this ordinance shall not become effective if actual construe
tion is not commenced by February 9, 1982 on the development of such Block 240
as provided in the deed dated August 9, 1980 in which City of Wichita Falls and
Midtown Now, Inc. conveyed it to Jimmy R. ��Mo//rris, Trustee.
