ORDINANCE GRANTING WAIVER OF SECTIONS 8-2, 8-15, 8-16,
and 27-5 OF THE CODE OF ORDINANCES ON MAY 4,1981 FOR
FESTIVAL OF MUSIC IN THE CENTRAL BUSINESS DISTRICT.
WHEREAS, the Musicians Clubs of Wichita Falls and the Wichita Falls Times
and Record News are sponsors of the National Week of Music and,
WHEREAS, permission has been requested that certain items be offered for sale
and displays and,
WHEREAS, Section 8-2 of the Code of Ordinances controls the advertising and
selling of goods on public right-of-way, Section 8-15 controls peddling on streets and
sidewalks, Section 8-16 prohibits peddlers from standing or stopping on streets, and
Section 27-5 restricts the storage of equipment and goods on streets and sidewalks.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF WICHITA FALLS, TEXAS THAT:
The provisions of said Section 8-2, 8-15, 8-16, and Section 27-5 of the Code of
Ordinances is hereby waived for the purpose of allowing the Festival of Music to offer
for sale certain arts and crafts, food, and beverages on May 4, 1981, in the Central
Business District; provided, however, that the Musicians Clubs of Wichita Falls and
its participants shall take every precaution to make sure that the sidewalk is safe
for pedestrians, and shall not allow merchandise to be placed on the sidewalk in such
a manner that it constitutes a hazard; further, the Musicians Clubs of Wichita Falls
and the participants in the Festival of Music shall indemnify the City from all liability
for damages arising out of the use of the sidewalk and streets for the display and sale
of merchandise.
