Res 225-83 11/15/1983RESOLUTION NO. c 1 RESOLUTION TO ESTABLISH THE RATES TO BE CHARGED THE CITY OF HOLLIDAY, TEXAS, FOR TRANSMITTED TREATED WATER WHEREAS, the City of Wichita Falls and the City of Holliday, entered into a Water Purchase Contract on December 1, 1968, and such contract contains provisions for modification of the rate structure at the end of every five year period; WHEREAS, the City of Wichita Falls in 1981, determined through a rate study that the proper rate to be charged Holliday under the contract is $0.4683 per 100 cubic feet, effective October 1, 1981; WHEREAS, Holliday would not agree to the October 1981 rate increase, contending that rate increases must occur only on the fifth anniversary dates of the contract rather than after a minimum period of five years as contended by the City of Wichita Falls; WHEREAS, the contending interpretations will be decided in the courts with a scheduled trial date of November 23, 1983; WHEREAS, the City of Wichita Falls desires to implement a new rate on December 1, 1983, should the interpretation of Holliday prevail in the courts; and, WHEREAS, the firm of Joe M. Nall and Associates has completed a rate study to determine the rates necessary to recover the Holliday portion of our cost of service from 1983 through 1988. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The proposed rate of $0.5807 per 100 cubic feet for provision of treated transmitted water to Holliday, Texas is approved. The new rate is to become effective on December 1, 1983. If the courts decide the October 1, 1981, rate increase is valid, the December 1, 1983, rate increase will not be implemented. If the courts do not allow the October 1, 1981, rate increase, then the December 1, 1983, rate increase will be implemented. PASSED AND APPROVED THIS THE 15TH DAY OF NOVEMBER, 1983.
