RESOLUTION APPROVING THE APPRAISALS OF
PROPERTIES FOR AN EASEMENT TO ACCOMODATE
AN EIGHT INCH FORCE MAIN AND AUTHORIZING
THEIR PURCHASE OR CONDEMNATION.
WHEREAS, it is necessary to acquire easements across
properites herein described for construction of an eight inch
sewage force main for disposal of sludge, and;
WHEREAS, such properties have been appraised by an
appraiser employed by the City of Wichita Falls and the amounts
of the values as determined from the appraisals have been studied
by the City Council , and copies are now in the possession of the
Acting Director of Public Utilities.
NOW THEREFORE, be it resolved by the City Council of the
City of Wichita Falls, Texas, that:
Section Ng. 1 The description of the easements to be purchased
are as follows:
C. B. Fuller Tract - 30, Pipeline Easement
Beginning at the intersection of the West boundary line of the J.
English Survey, A-70, Wichita County, Texas, and the North right
of way line of River Road as fenced, thence Northeast along the
North right of way line of River Road an approximate distance of
1200 feet to the point of beginning of the herein described
easement;
Thence Northeast along the north right-of-way line of River Road
an approximate distance of 450 feet to the east bank of the Big
Wichita River and also being the East property line of the C. B.
Fuller 16. 58 acre tract;
Thence Northwest along the East property line of the C. B. Fuller
tract a distance of 30 feet to a point;
Thence Southwest parallel to the North right-of-way line of River
Road an approximate distance of 450 feet to a point;
Thence, Southeast perpendicular to the North right-of-way line of
River Road a distance of 30 feet to the point of beginning of
herein described easement.
B. D. Wright Tract - 30' Pigeline Easement
Beginning at the intersection of the West boundary line of the
J. English Survey, A-70, Wichita County, Texas and the North
right-of-way line of River Road as fenced, thence Northeast along
the north right-of-way line of River Road an approximate distance
of 1650 feet to the East bank of the Big Wichita River, and the
point of beginning of herein described easement;
Thence Northeast along the North right-of-way line of River Road
an approximate distance of 250 feet to a point;
Thence Northwest perpendicular to the North right-of-way line of
River Road a distance of 30 feet to a point;
Thence Southwest parallel to the North right-of-way line of River
Road an approximate distance of 250 feet to a point on the East
bank of the Big Wichita River;
Thence Southeast along the east bank of the Big Wichita River
a distance of 30 feet to the point of beginning of herein describe
easement.
Section No. 2 The values of such easements are hereby approved
and the City Manager is hereby authorized to purchase the herein
described easements in the name of the City of Wichita Falls.
The authorized price to be paid for such tracts are the values as
determined from the appraisals made by the real estate appraiser
employed by the City of Wichita Falls.
Section No 3 In the event the City Manager is unable to
purchase such easements for such approved values, he is hereby
authorized and directed to cause to be instituted, condemnation
proceedings to obtain such easements in the name of the City of
Wichita Falls.
