RESOLUTION ACCEPTING THE PROVISIONS OF THE STATE
HIGHWAY PUBLIC TRANSPORTATION COMMISSION MINUTE
ORDER NUMBER 81169-34 FOR ASSISTANCE IN THE RECON-
STRUCTION ON BARNETT ROAD FROM FARM TO MARKET ROAD
369 TO US 277 IN THE CITY OF WICHITA FALLS .
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS ,
TEXAS, THAT:
The provisions of Minute Order No. 81169-34 , passed by the State
Highway and Public Transportation Commission on August 25, 1983 , a
copy of which is attached hereto, and is made a part thereof, providing
for requested assistance in the reconstruction on Barnett Road from
Farm to Market Road 369 to US 277 in the City of Wichita Falls, is
acceptable to the City of Wichita Falls . This project was selected
by the City of Wichita Falls in cooperation with the State Department
of Highways and Public Transportation and fulfills its obligations
so stipulated in said Minute Order as being the responsibility of the
City.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
The City of Wichita Falls desires the State Department of
Highways and Public Transportation to include the City' s portion of
the work in the State ' s construction contract, and the City Manager
of the City of Wichita Falls is hereby authorized to enter into an
agreement with the State Highway Department for such work and its
cost, as may be mutually agreed upon.

WHEREAS, in WICHITA CCtJNT Y, the City of Wichita Falls has requested assistance in
reconstruction on Barnett Road from Farm to Market Read 369 to U. S. Highway 277, a
distance of approximately 1.5 miles; and
WHEREAS, Barnett Road is included in the Urban System; and
WHEREAS, it is the desire of the State Department of Highways and Public Transportation

1. Furnish all required right of way clear of obstructions with acquisition pro-
cedures to be in accordance with applicable Federal and State laws governing
the acquisition policies for acquiring real property.
2. Provide for the adjustment of utilities as may be required.

3. Provide fonds required for construction of the project in excess of the funds
authorirld in the 1933-1936 Urban System Program including construction of
contin.u. .ls curb and gutter, storm severs, driveways and sidewalks as may be
required.
4. Maintain all of the work constructed as part of the project and agree to
regulate traffic and prevent encroachment on the right of way, all in
accordance with governing policies and regulations of the Department.

Subject to the availability of Federal-aid Urban System funds and the eligibility of
the proposed work for financing with said funds, the State Department of highways and
Public Transportation will:
1. Prepare construction plans and specifications.
2. Provide for Reconstruction of Grading, Structures and Surfacing at an esti-
mated cost of $654,900 as authorized in the 1983-1936 Urban System Program.
Upon acceptance of the provisions of this Order by the appropriate officials of the
City of Wichita Falls, IT IS ORDERED that Barnett Road extending from Farm to Market
Road 369 to U. S. Highway 277, a distance of approximately 1.5 miles, be and is hereby
designated as a METROPOLITAN HIGHWAY and the Engineer-Director is directed to enter
into any necessary agreements with the City covering the details of the proposed im-
provements, to proceed with the engineering development of the project and after the
City has fulfilled its responsibilities, to proceed with construction in the most
feasible and economical manner.
It is understood that the City may discharge its construction obligations as outlined
herein in any ;canner as it may elect. In the event the City desires the State to in-
clude its portion of the work in the State's construction contract, the Engineer-
Director is hereby authorized to enter into agreement with the City for such work and
its cost as may be agreed upon.
This Order shall become operative upon acceptance by the City of WicL'_ta Falls and if
not accepted within 90 days of the date hereof, the action herein contained shall be
automatically cancelled.
