RESOLUTION DECLARING CERTAIN LAND OWNED BY THE
CITY IN BLOCK 163, ORIGINAL TOWN, TO BE EXCESS
AND SURPLUS LAND, AND DIRECTING THAT SAID LAND
BE ADVERTISED FOR SALE ON SEALED BIDS .
WHEREAS, heretofore the City of Wichita Falls has acquired the
east one-half of Lot 1, the east one-half of Lot 2 , and all of Lots
3, 4, and 5, Block 163 , Original Town of Wichita Falls , for parking
for the Farmers ' Market and the Activities Center; and,
WHEREAS, although the acquisition of such property by the City
was made in good faith for the construction of parking facilities,
it is now found that it would be more in the public interest for
such parking facilities to be owned, constructed and operated by
private interests .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1 . The necessity of acquiring the above property, and
the public purpose on which it was based, no longer exist.
SECTION 2 . The above described land owned by the City of Wichita
Falls in said Block 163 is declared to be excess and suplus land,
and should be sold by the City, subject to the provisions contained
in Section 3 .
SECTION 3 . The City Manager is hereby authorized and directed
to publish in a newspaper of general circulation in Wichita County,
Texas, a notice that such land is to be offered for sale to the
general public on sealed bids in accordance with Article 5421c-12,
Revised Civil Statutes of Texas; notice shall be so given on at
least two separate occasions, and no sale shall be held less than 14
days after the last notice.
The sale shall be made subject to the following qualifications :
A. A minimum bid of $46 ,900 .00 will be required.
B. The sale and deed would be subject to a condition subsequent
that the title to the land would revert to the City unless the

purchaser submitted to the City within six months of the deed
preliminary plans for private development of parking facilities
on such property (which plans would provide for screening, land-
scaping and street amenities which are acceptable to the Design
Review Commission of Wichita Falls) , began actual construction of
such parking improvements on such land within nine months of the
deed, and invested a minimum of $45, 000 .00, exclusive of land cost,
in the development of such parking facilities; once actual construc-
tion is begun, the construction shall proceed with reasonable
diligence to completion. In the event the land should revert to the
City, the City shall repay to the purchaser 75 percent of the purchase
price which purchaser paid City for such property.
