A RESOLUTION DESIGNATING A TRACT OF LAND AS DEATON &
WAGGONER BLIGHTED AREA NO. 1
WHEREAS, an area hereafter called the Deaton & Waggoner Blighted Area
No. 1 is located within the City of Wichita Falls, Texas; and,
WHEREAS, the proposed Deaton & Waggoner Blighted Area No. 1 is described
as follows:
A TRACT OF LAND out of the John V. Wheeler Survey, A-377 and the E.A.
Austin Survey A-701, Wichita County, Texas said tract being more specif-
ically described by metes and bounds as follows :
BEGINNING at a point in the South line of the above mentioned John V.
Wheeler Survey, which bears West 1344.8 feet from its Southeast corner;
said point also lies in the North line of the aforementioned E.A. Austin
Survey;
THENCE West along the South line of the aforementioned John V. Wheeler
Survey a distance of 95.0 feet;
THENCE along the West line of Morningside Park as follows: South 419.9
feet; East 77.9 feet; South 11 30' East 151.8 feet; North 59° 35' East
45.0 feet; South 06° 40' West 56.2 feet; South 19° 45' East 83.0 feet
to a point for the Southeast corner of this tract;
THENCE West 748.5 feet to a point for the Southwest corner of this tract;
THENCE North passing along the East line of the Harrell School tract a
distance of 1683.4 feet to a point in a curve of the South line of U.S.
Highway No. 277 for the Northwest corner of this tract;
THENCE along a 2.053 degree curve to the right in a Northeasterly
direction a distance of 517.19 feet, the long chord of said curve bears
North 76° 43' 07" East 516.45 feet;
THENCE leaving the South right-of-way line of the aforementioned U.S.
Highway No. 277, South

34' East 198.6 feet;
THENCE South 96.3 feet;
THENCE East 102.6 feet;
THENCE South 846.1 feet to the place of beginning and containing 25.76
Acres, more or less; and,
WHEREAS, the map of the proposed Deaton & Waggoner Blighted Area No. 1
is incorporated as part of this resolution; and,
WHEREAS, the City Council finds designation of the Deaton & Waggoner
Blighted Area No. 1 is justified for the following reasons:
There is a need to develop additional employment opportunities for
persons in the Wichita Falls community.

There are a substantial number of substandard structures within the
City of Wichita Falls, including approximately 6,830 homes in struc-
turally poor condition and approximately 7,400 homes exposed to flooding
in the 100-year flood plain.
The large amount of vacant land within the city constitutes an
economic liability.
The development of property in a manner which enhances the tax base
is essential to the City of Wichita Falls.
The unemployment rate in the Deaton & Waggoner Blighted Area No. 1
is 7.4%, which is higher than the city-wide rate of 6.7%.
Approximately 33% of the structures in the Deaton & Waggoner Blighted
Area are substandard, which is higher than the city rate of 22%.
A large amount of vacant land exists within the Deaton & Waggoner
Blighted Area No. 1 despite city policies encouraging infill develop-
ment; and,
WHEREAS, objectives of the City of Wichita Falls include the infill of
vacant land, enhancement of theaposition of Wichita Falls as a regional service
and retail center, provision of an adequate supply of employment opportunities,
and maintaining an adequate ad valorem tax base to meet community requirements; and,
WHEREAS, the availability of financing of projects for commercial uses
under the Development Corporation Act of 1979 (Article 5190.6 Vernon's Texas Civil
Statutes, as amended) will contribute significantly to the alleviation of the
blighted conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS THAT:
SECTION 1. The Deaton & Waggoner Blighted Area No. 1 is hereby desig-
nated as a blighted area by the City of Wichita Falls and that the Texas Industrial
Commission is requested to accept the blighted area for commercial projects in
accordance with the provisions of the Development Corporation Act of 1979 and the
administrative rules and regulations adopted under its authority.
SECTION 2. The City Council shall review all project descriptions for
approval. Specific projects for commercial uses shall be reviewed in order to
determine whether such projects are consistent with the City's objectives and
guidelines for development of the Blighted Area.
A. Desired projects are those which will result in significantly
enhanced employment opportunities for local residents and which will strengthen
the community economy and improve the position of the city as a regional service
and retail center.

B. Detrimental uses include those uses which would have a significant
negative impact on residential areas or which would not complement businesses in
the surrounding areas.
C. More specifically, the City Council shall use the following criteria
when evaluating projects for Industrial Revenue Bond funding:
1) Use of Industrial Revenue Bond funds is necessary to make the
project financially feasible.
2) No project shall be approved if the parcel of land on which the
project is to be located is limited by deed restrictions to residential purposes.
No project shall be approved if the proposed use would constitute a violation of
the deed restrictions placed upon said parcel.
3) At least 70 percent of the workers on a craft-by-craft basis
shall be residents of the Wichita Falls Standard Metropolitan Statistical Area.
An exception to this policy may be granted by the City Council, in any case where
it is proven that there are not sufficient resident workers available in a par-
ticular craft to meet the requirements of this resolution.
D. In order to assure compliance with the conditions of this resolu-
tion, the developer shall submit an annual report containing detailed documentation
that all requirements are being met. A final report shall be submitted when all
requirements have been met and the project has been completed. The City Council
may require the posting of bonds, authorize execution of a binding contract, or
take other steps to assure compliance with all requirements.
SECTION 3. Public improvements in the area are expected to include
streets, drainage, and public utility line installation. Improvements will be
made at the expense of the developer and will be scheduled as part of the platting
process.
