RESOLUTION APPROVING AND AUTHORIZING THE CITY
MANAGER TO EXECUTE A CONTRACT WITH BIGGS AND
MATHEWS, INC. , FOR PROFESSIONAL SERVICES ON
SANITARY SEWER MAINS
WHEREAS, the City of Wichita Falls proposes to have portions
of the sanitary sewer system inspected and repaired; and,
WHEREAS, the City wishes to employ the firm of Biggs and
Mathews, Inc. , to provide the engineering services required.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT;
The firm of Biggs and Mathews, Inc. , has agreed to provide
engineering services according to the attached contract. This contract
is hereby accepted and the City Manager is authorized to execute the
contract for the City of Wichita Falls.

This Contract, made and entered into as of the day of 1983,
by and between the City of Wichita Falls, Wichita Falls, Texas (hereinafter
called "Owner") and the firm of Biggs & Mathews , Inc . , Consulting Engineers,
Wichita Falls, Texas (hereinafter called "Engineer") .
WITNESSETH:
WHEREAS, the Owner will require infiltration and inflow analyses and field
testing of selected parts of the sanitary sewer system within the City of
Wichita Falls and
WHEREAS, the firm of Biggs & Mathews, Inc . is acceptable to the Owner and
is willing to enter into a contract to perform engineering services required by
the Owner;
NOW THEREFORE, it is agreed as follows:
I .
The Owner hereby retains the Engineer for all engineering services re-
quired for testing, analyses and recommendations concerning possible rehabili-
tation of selected parts of the sanitary sewer system. The services performed
by the Engineer in connection with the above shall be as follows :
1) An office evaluation of the worst problem areas within the sanitary
sewer system.
2) Interviews with City operating personnel to determine the lines for
testing .
3) Prepare preliminary maps showing lines recommended to be tested for
concurrence by the City.

4) Smoke testing of lines selected after the above evaluation .
5) After smoke testing, determine the lines to be further inspected by
television.
6) A full report listing the results of testing and recommendations for
corrective action. A single copy of testing reports and photographs
and three copies of the evaluation report and recommendations shall be
submitted.
II
For the basic services performed under Section I of this agreement, the
compensation to the Engineer shall be as follows :
1) Professional fees:
a) Principal of Firm 50.00 per hour
b) Project Engineer 40.00 per hour
c) Draftsman 20.00 per hour
d) Typing 20.00 per hour
2) Smoke testing at cost plus fifteen (15%) percent, not to exceed $0 .35
per lineal foot .
3) Television inspection at cost plus fifteen (15%) percent not to exceed
2.30 per lineal foot.
4) Out of pocket expenses at cost plus fifteen (15%) percent .
III
It is understood and agreed that the maximum amount to be paid for all
testing, supervision and reports is $30,000.00. The Engineer shall smoke test
a minimum of 39,500 lineal feet of main line pipe to be selected for effective
testing. If television inspection is determined to be required , then a maximum
of 2,000 lineal feet shall be so inspected; otherwise, additional smoke testing
shall be performed at the above payment rate. If television inspection is not
required , then an additional 10,000 lineal feet of main line pipe shall be
smoke tested.

The time to perform the service herein above outlined shall be seventy-
five (75) calendar days after written notice to commence the work.
V
It is understood and agreed that the Owner shall have complete control of
the services to be rendered and that no work shall be done under this contract
until the Engineer is instructed in writing to proceed with the work. At the
time written instructions are given to the Engineer to proceed , evidence shall
be furnished that funds are available to pay for the services rendered .
VI
Any provision in this contract notwithstanding, it is specifically under-
stood and agreed that the Engineer shall not authorize or undertake any work
pursuant to this contract, which work would require the payment of any charge,
expense or reimbursement in addition to the charges stipulated in Sections II
and III , without having first had and obtained specific written authority.
VII
This contract shall not be assignable in whole or in part without the
consent of the Owner .
VIII
Payments to the Engineer shall be on a monthly basis for smoke testing and
television inspection as invoiced to the Engineer by the testing company.

Payment for all other work shall be due and payable within thirty (30)
days after all testing has been completed and the full report submitted to the
City.
All payments for services rendered by the Engineer that have not been paid
within sixty (60) days after becoming due shall thereafter accrue interest at
the rate of eighteen (18%) percent per annum.
IX
In connection with all the work outlined or contemplated above, it is
agreed that the Owner or the Engineer may cancel or terminate this contract .
Upon thirty (30) days written notice of such cancellation from either party to
the other, all work and labor being performed under this contract shall imme-
diately cease, pending final cancellation at the end of such thirty day period ,
and further provided that the Engineer shall be compensated in accordance with
the terms of this agreement for all work accomplished by him prior to the re-
ceipt of notice of such termination .
X
The City of Wichita Falls or any of its duly authorized representatives
shall have access to any books, documents, papers and records of the Engineer
which are directly pertinent to this project for the purpose of making accurate
examination, excerpts and transcription.
XI
The City will be responsible for notification of the citizens and various
City departments prior to the smoke testing of the particular area. Also
additional City responsibilities are as follows:

1) Notification of the various City departments and citizens in the area
to be smoke tested.
2) Cleaning, as required, of any lines to be inspected by television .
3) Locations of manholes obscured by paving and other materials together
with the removal of covers that cannot be readily opened .
4) Permission to enter private property, where required .
The Engineer shall have access to any existing City plats and records in
the possession of the Owner that will be of benefit in the preparation of the
testing and project report .
IN WITNESS HEREOF, the City of Wichita Falls, Texas has caused this con-
tract to be executed by its City Manager and attested by its City Clerk and the
official seal of the City affixed hereto, and Biggs & Mathews , Inc . , Consulting
Engineers, has caused this contract to be executed by its President and its
Secretary, with all such executions being in triplicate, each of which shall
constitute an original , and all of which has been done as of the date here
above first written .

2) Cleaning, as required, of any lines to be inspected by television .
3) Locations of manholes obscured by paving and other materials together
with the removal of covers that cannot be readily opened .
4) Permission to enter private property, where required .
The Engineer shall have access to any existing City plats and records in
the possession of the Owner that will be of benefit in the preparation of the
testing and project report .
IN WITNESS HEREOF, the City of Wichita Falls, Texas has caused this con-
tract to be executed by its City Manager and attested by its City Clerk and the
official seal of the City affixed hereto , and Biggs & Mathews , Inc . , Consulting
Engineers, has caused this contract to be executed by its President and its
Secretary, with all such executions being in triplicate, each of which shall
constitute an original , and all of which has been done as of the date here
above first written .
