RESOLUTION WAIVING SECTION d OF RESOLUTION NO.
130-83, AND APPROVING AND AUTHORIZING THE CITY
MANAGER TO EXECUTE A SANITARY WASTE WATER
DISPOSAL AND TREATMENT CONTRACT WITH THE CITY
OF LAKESIDE CITY .
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
1 . Because Lakeside City as a general law city cannot by
law make an application to be annexed by the City of Wichita Falls,
the provisions of Section d of Resolution No. 130-83 concerning
such application for annexation to the City of Wichita Falls is
hereby waived.
2 . The City Manager is hereby authorized to execute for the
City of Wichita Falls a sanitary waste water disposal and treatment
contract with the City of Lakeside City, incorporating therein the
following conditions, to-wit:
A. All costs to establish the service, including engineering
studies, administration, and the physical system, shall be born by
Lakeside City. This also includes any adjustments required in the
utility system of the City of Wichita Falls that are necessary to
provide the requested service.
B. The contract shall provide for the establishment of a rate
to be paid by Lakeside City, based upon the cost of providing the
service by the City of Wichita Falls, such costs to be computed using
generally accepted rate setting techniques and procedures . The rate
shall be based upon the volume of waste water which shall be
discharged into the Wichita Falls waste water collection system as
separately metered at the point of entry into the Wichita Falls
system. Furthermore, the rate charged to Lakeside City shall be
not more than one and one-half times the cost of the service charged
to like customers within the City limits . Such rates are to include
the capital investments, if any, as incurred by the City of Wichita
Falls in order to continue and improve the service in the future.
C. The rates established herein shall be subject to review
and adjustment on an annual basis, on or about the anniversary date
of the contract.
D. Lakeside City will agree that any new utilities systems or
subdivisions hereafter built will be built in conformance with
standards which are equal to or exceed the standards and specifications
of the Wichita Falls utility system and Wichita Falls subdivision
ordinance, building code and electrical code.
E . The contract shall provide that no more than 520 dwelling
units shall be connected to or serviced by the Lakeside City sewer
system. The number of dwelling units connected to the sewer system
shall be established by a certificate furnished by Lakeside City
annually in accordance with a sewer audit.
F. At such time as 520 dwelling units have been connected to
the Lakeside City sewer system, this contract shall be renegotiated
with regard to all its terms with a view toward determining the
mutual benefit to the City of Lakeside City and its citizens and
the City of Wichita Falls and its citizens for Lakeside City to
disincorporate so as to allow annexation of the area to the City of
Wichita Falls .
