Res 142-83 8/2/1983RESOLUTION 1 —'3 RESOLUTION DECLARING NECESSITY FOR ACQUIRING, APPROVING APPRAISAL AND AUTHORIZING PURCHASE OR CONDEMNATION OF CERTAIN PROPERTY FOR THE STREET RIGHT-OF-WAY ON NORTHWEST DRIVE, 1980- 82 CAPITAL IMPROVEMENT PROGRAM. WHEREAS, it is necessary to acquire the property hereinafter described for the street right-of-way on Northwest Drive, 1980-82 Capital Improvement Program; and, WHEREAS, such property has been appraised by an independent appraiser employed by the City for this purpose, and the amount of the appraisal has been studied by the Board of Aldermen, and copies of same are now in pos- session of the Director of Public Works, NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS THAT: Section No. 1 It is necessary to acquire the fee simple title to the following property in Wichita Falls, Texas: NORTHWEST DRIVE STREET IMPROVEMENT 1980-82 CAPITAL IMPROVEMENT PROGRAM Being an 0.4 acre tract of land situated in the David Welch Survey, Abstract 324, Wichita County, Texas, and a part of the 214 acres conveyed by Gordon T. West to Lane T. West, Reece A. West and Gordon T. West Jr. by deed dated December 24, 1949 and recorded in Volume 850, Page 237 Deed Records of Wichita County, Texas, said 0.4 acre tract being more particularly described as follows: BEGINNING at a point in the west right-of-way line of State Loop 11 Highway, also being in the north right-of-way line of North- West Drive, said point being located South 88 degrees 44' 04" East, along said north right-of-way line a distance of 1126.7 feet from the west line of the David Welch Survey; THENCE, North 88 degrees 44' 04" West, along said north right-of-way line of Northwest Drive a distance of 1126.7 feet to a point in the west line of the David Welch Survey, also being the west property line of the said 214 acre tract of land; THENCE, North a distance of 15 feet along the west line of the David Welch Survey also being the west property line of the said 214 acre tract of land to a point for corner of the proposed right- of-way line of Northwest Drive; THENCE, S 88 degrees 44'04"E.parallel to the existing north right-of- way line of Northwest Drive a distance of 1178.2 feet to a point in the existing northwesterly right-of-way line of State Loop 11 Highway; THENCE, S 76 degrees 22' 38" W on and along the said northwesterly right- of-way line of State Loop 11 Highway a distance of 70.1 feet to the place of beginning. Said above described tract of land contains 0.4 acres more or less. Total value appraised in this resolution 2,600.00 Page of Panes Agenda Item No. Section No. 2 The approved value of such property is hereby approved and the City Manager is hereby authorized to purchase by Warranty Deed such tract of land in the name of the City of Wichita Falls, Texas. The authorized price to be paid for such tract is the value as determined by the appraisal made by the independent appraiser referred to above. Section No. 3 In event the City Manager is unable to purchase any such tract for such approved value he is hereby authorized and directed to cause to be instituted condemnation proceedings to obtain such tract in the name of the City of Wichita Falls, Texas. He is further authorized, when in his judgment it appears to be in the best interest of the City to do so, to purchase such property for more than the appraised value in order to save the estimated cost of condemnation.
