J fr3 RESOLUTION DECLARING THAT A CERTAIN TRACT OF LAND ACQUIRED BY THE STATE OF TEXAS ON KELL BOULEVARD IS NO LONGER NEEDED FOR HIGHWAY OR PUBLIC TRANSPOR- TATION PURPOSES AND RECOMMENDING THAT THE STATE SELL SUCH LAND. WHEREAS, the State of Texas acquired the hereinafter described tract of land on Kell Boulevard for highway purposes, and the State Department of High- ways and Public Transportation has recommended that such land is surplus to the State's needs, and that the same be sold. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: That certain tract of land, which is shown as Tract No. 14 and described in Exhibit A which is attached hereto and incorporated herein, is no longer needed for highway or public transportation purposes by the citizens or City of Wichita Falls, and it is recommended that the State sell such tract of land in accordance with the statutes of the State of Texas. O. Box 1431 Wichita Falls , Texas 76307 Dear Mr. Lillard : e1 In response to your request, we are furnishing you the steps involved in the sale of surplus right of way on the subject projects . They are listed as follows : 1 . The District Enaineer's Statement is submitted to the City of Wichita Falls with our request that the City agree that the -- subject property is surplus. 2. The City concurs that the property is surplus by .furnishing . 1 the State a City Council Resolution. 3 . The District Engineer 's statement, Council -Resolution and other related material are sent to our Austin Office for review and concurrence. The Highway Administration must concur in the matter and authorize the District Office to proceed . 4. When the Highway Administration concurs in these findings , tij then we will obtain appraisals on each tract. 5 . The appraisals will be reviewed by the District Office and sent to our Austin Office for a final "approved value" . 6 . The Austin Office will send us the approved value for each tract . They will also send us a notice of sale to he published in the local newspaper along with the necessary hid forms . The notice will appear once a week for three consecutive weeks prior to the bid opening. The sale will be by sealed bid .j 1 Mr. Ernest Lillard October 15 , 1982 Page -2- I 7. Bidders will send their sealed bids to the District Engineer' s Office which will be opened at the- prescribed time. S. After the bids are opened , the District Engineer will forward the successful bid and bid check to the -Austin Office with his recommendation of acceptance or rejection. All other bid checks will be returned to the unsuccessful bidders. 9. The Highway Administration will review the bids .and recommend I their acceptance to the State Highway and Public Transportation Commission. The Quitclaim instrument -must be approved by the Attorney General and approved and signed by the Governor. The successful bidder will he required to pay a service charge of 100.00 or 1 % of the sale price, whichever is the greater, so that . the Quitclaim will be processed: 10. The City must request that they be reimbursed for a percent- age of the bid price .
