AN ORDINANCE CLOSING, VACATING, AND ABANDONING A PORTION
OF A FIFTEEN (15) FOOT UTILITY EASEMENT IN PROPOSED LOT
2, BLOCK 21, MIDWESTERN PARK SUBDIVISION
WHEREAS, the owner of property of proposed Lot 2, Block 21, Midwestern
Park Subdivision as shown on the 21st revised preliminary plat of Midwestern Park
Subdivision has requested the closing, vacating and abandoning of a portion of
the fifteen (15) foot utility easement conveyed by Louis Sikes to the City of
Wichita Falls and recorded in volume 1013, page 559, Wichita County Deed Records;
and,
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas deems
it advisable and in the public interest to close, vacate and abandon the portion
of the fifteen (15) foot utility easement hereinafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
The portion of the fifteen (15) foot utility easement out of the Day
Land & Cattle Co. Survey, A-619, Wichita County, Texas, and being more specifically
described by metes and bounds as follows:
BEGINNING at a point in the north easement line of a 15 foot sewer
easement conveyed by Louis Sikes to the City of Wichita Falls and
recorded in Volume 1013, Page 559, Wichita County Deed Records, said
point bears north 89° 28' west 17.37 feet and south 00° 32' west
722.90 feet from the northeast corner of the T.J. English Survey,
A-354, Wichita County, Texas, and the northwest corner of the J.M.
English Survey, A-355, Wichita County, Texas, said point being the
northeast corner and place of beginning of this description;
THENCE south 71° 49' west 335.65 feet to a point for the northwest
corner of this easement;
THENCE south 18° 11' east 15.00 feet to a point for the southwest
corner of this easement;
THENCE north 71° 49' east 335.65 feet to a point for the southeast
corner of this easement;
THENCE north 18° 11' west 15.00 feet to the place of beginning and
containing 0.116 acres, or 5035 square feet, more or less;
be and the same permanently closed, vacated, and abandoned.
