5E IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF

SECTION 1. Ordinance No. 3758 is hereby amended so that

J.:=Ission" shall be changed to read "Motor Vehicle Salvage
,n.:/or Junk Yard Commission", the term "motor vehicle junk
yard" shall be chanced to read "motor vehicle salvage and/or

read "salvage and/or junk yard _".
SECTION 2. Subsection A of Section 1 of Ordinance No. 3758

Ls hereby amended by adding to it a sentence which reads as
follows:

SECTION 3. Subsection B of Section 4 of Ordinance No. 3758 -
is hereby amended by adding, after the word "misdemeanor" in

the first sentence, the phrase "(except for a misdemeanor traffic

SECTION 4. The last clause in Subsection D of Section 4 I
of Ordinance No. 3758 is hereby amended to read as follows: I

"however, the applicant shall have the right to appeal
and have a review before the City Manager or Assistant
City Manager of the City, and if either concur in the
action of the Director of Public Works in suspending
said license, his decision shall be final, unless
applicant is otherwise entitled to judicial review
under the law of Texas."
SECTION 5. Subsection E of Section 1 of Ordinance 3758,which
requires a bond, is hereby repealed. Further, Section 13 of ..,. —
such ordinance is hereby amended by deleting the last sentence •
in such section, and changing the next to last sentence in such ,
section to read as follows, "In addition to the penalties imposed

Commission shall take into consideration the comments .
of the owners of the neighboring properties; further,
the Commission shall consider the uses made of the
surrounding properties at the time the business in .

business since it was initiated."
SECTION 7. Section 9 of Ordinance No. 3758 is hereby

amended by adding to the end of such section a sentence which ..
reads as follows:
"A chain link fence in which slats made of metal or

SECTION 8. The fact that prosecutions under Ordinance
No. 3758 were not to begin until recently, and the amendments III
contained herein seriously affect the operation of motor vehicle • -

emergency, and this ordinance shall become effective upon its
passage: No prosecution shall be commenced as a result of
Ordinance No. 3758 until 30 days after the effective date of
