ORDINANCE GRANTING WAIVER OF ORDINANCE NO. 3457 ,
AS AMENDED, TO ALLOW ISSUANCE OF BUILDING AND
OTHER PERMITS FOR LOT 4 , BLOCK 4 , BROOK AVENUE
ADDITION.
WHEREAS , the restrictions in Brook Avenue Addition
provide that no building other than a private dwelling house
to be used and occupied for resident purposes and the stable
and out-buildings appurtenant thereto shall be erected on
any lot, nor shall any lot be used for any but private
residence purposes ; and,
WHEREAS , the owner of Lot 4 , Block 4 , of said addition,
located at 2211 Brook Street, desiresthe necessary permits
to construct a commercial building on such property; and,
WHEREAS , it appears that the above restriction has
been waived insofar as this lot is concerned.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS , TEXAS , THAT:
If, within 9 months from the passage of this ordinance,
the owner of such property or his successors complies with
all other applicable codes and ordinances concerning
construction of a commercial building on this lot, then and
in that event Ordinance No. 3457 , as amended, shall be waived,
and the appropriate City Departments will be authorized to
issue the permits necessary for the work sought to be done
by the owner thereof.
