AN ORDINANCE CLOSING, VACATING, AND ABANDONING THE FIVE
(5) FOOT EAST - WEST UTILITY EASEMENT IN LOT 2, MINI-
VENTURE SUBDIVISION TO THE CITY OF WICHITA FALLS
WHEREAS, the Planning Board of the City of Wichita Falls, Texas has
recommended closure of the five (5) foot east-west utility easement in Lot 2,
Mini-Venture Subdivision; and,
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas
deems it advisable and in the public interest to close, abandon, and vacate
the utility easement hereinunder described.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS, TEXAS THAT:
SECTION 1. The five (5) foot utility easement lying north of the
south lot line of Lot 2, Mini-Venture Subdivision and bounded in the west by the
east right-of-way line of Fairway Boulevard and in the east by the west boundary
of the five (5) foot north-south easement abutting the east boundary of said
Lot 2, be and the same is hereby closed, vacated, and abandoned.
SECTION 2. This ordinance shall become effective upon filing with
the Wichita County Clerk of a replat of said Lot 2 and the unplatted parcel of
land lying immediately south thereof into one lot, within one (1) year of the
date of passage of this ordinance.
