ORDINANCE AMENDING ORDINANCE NO. 3758 , AS
AMENDED, TO ADD TWO ADDITIONAL MEMBERS TO
THE MOTOR VEHICLE SALVAGE AND/OR JUNK YARD
COMMISSION, TO DELETE THE REQUIREMENT IN
THE APPLICATION TO NAME MISDEMEANOR CON-
VICTIONS, TO DELETE THE STIPULATION IN THE
APPLICATION THAT SUSPENSION OF LICENSE WHICH
IS APPROVED BY THE CITY MANAGER OR ASSISTANT
CITY MANAGER SHALL BE FINAL, TO CHANGE THE
REQUIREMENTS CONCERNING FENCING, AND TO ALLOW
STACKING OF CERTAIN CRUSHED VEHICLES,
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS , TEXAS , THAT:
SECTION 1. Subsection A of Section 1 of Ordinance No. 3758 ,
as amended, is hereby amended to read as follows:
"A) The Commission shall be composed of
five members and five alternates, appointed
by the Board of Aldermen to serve without
compensation. Each member and alternate
shall be appointed to serve a one year term
and shall not be appointed as a member or
alternate more than five consecutive terms;
however, a member or alternate may be re-
appointed to the Commission after an absence
of three years. A member and alternate shall
be appointed from the then present membership
of the Planning Board, Clean Community Commission,
and the City-County Health Department, from
the motor vehicle salvage and/or junk yard
industry, and from the public at large. If
a member is unable to attend a meeting, his
alternate shall attend and act in his place. "
SECTION 2 . Subsection B of Section 4 of Ordinance No. 3758,
as amended, is hereby amended by deleting the phrase "or of a
misdemeanor (except for a misdemeanor traffic violation) " .
SECTION 3 . Subsection D of Section 4 of Ordinance No. 3758 ,
as amended, which provides that each application shall stipulate
that, if a license is suspended and such suspension is concurred
in by the City Manager or Assistant City Manager,
his decision
shall be final, is hereby repealed.
SECTION 4 . The first sentence in Section 5 of Ordinance
No. 3758, as amended, is hereby amended by deleting the words
"and bond" from such sentence.
SECTION 5. Section 5. 1 of Ordinance No. 3758 is hereby
amended to read as follows:
"The Commission may, if requested with
the application, also hold a hearing on
applicant' s request to waive a portion of
the fencing requirements of Section 9 of
this ordinance. The Commission has the
authority to waive the screening require-
ments when man-made or natural features or
terrain exist which would provide or make
unnecessary any further screening at that
point, or when screening at certain points
would serve no useful purpose. Prior to
granting a waiver, the Commission shall
find either that the waiver will not allow
applicant' s location to be reasonably viewed
from a street or highway or that other
similar structures that block vision are
present along the portion of the applicant' s
location where the waiver is to be granted;
further, the Commission shall further find
that granting the waiver will not expose the
applicant ' s operation to the view of other
property so as to unreasonably interfere with
the enjoyment of the use of such other
property. The Commission shall have the right
to rescind any waiver previously granted
should, for any reason, the man-made or natural
features considered when granting a waiver be
removed or altered. Should the applicant wish
to appeal the Commission ' s decision regarding
the waiver of the fencing requirements or the
recision of any waiver, the applicant must
request a review within ten working days in
writing to the City Clerk. The review of the
decision shall be made by the City Manager or
Assistant City Manager, either of whom shall
have the authority to uphold, reverse or modify
the decision of the Commission. The decision

of the City Manager or Assistant City
Manager shall be final. "
SECTION 6. The second sentence in Section 10 of Ordinance
No. 3758 is hereby amended to read as follows:
"Vehicles shall not be placed on top of
one another (unless they have been crushed
and are being prepared to be sent to a
processing plant) and shall be placed as
near as possible in the normal driving or
upright position. "
SECTION 7 . No prosecutions shall be commenced under
Ordinance No. 3758 until 91?' days after the effective date of
this ordinance.
