ORDINANCE AMENDING SECTION 17-3; 17-6; 17-8; 17-14;
17-19; AND 17-62 OF THE CODE OF ORDINANCES TO
INCREASE THE CHARGE FOR CARRY OUT SANITATION
SERVICE; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. Section 17-3 is amended to read as follows :
"Each owner, occupant , tenant or leasee receiving curbside
collection shall provide suitable leak proof refuse containers
for garbage and trash of not less than ten nor more than
thirty gallons capacity, constructed of substantial material
and maintained in good condition with tight fitting lid or
cover. Plastic bags designed for the disposal of household
garbage and refuse may be used. Plastic bags shall be
sufficient strength (Minimum 2 mil) to resist tearing under
normal handling and tied securely when placed for collection.
The Sanitation Superintendent shall have the authority to
require substitutions when he or his representatives determine
the type containers or bags used are inadequate for intended
service. "
SECTION 2. Section 17-6 is amended to read as follows :
"If there is no alley or if the alley is unpaved refuse shall
be placed in an authorized container and placed at a point
adjacent to the front curb no earlier than the scheduled day
of collection and not later than 7 : 00 a.m. on the day of
scheduled collection. (Paved alleys which will not accomodate
garbage vehicles shall have refuse placed as if there was no
alley. ) Refuse cans , can racks , or permanent or semi-permanent
refuse container holders of any nature shall not be allowed to
remain on the curb except that the Sanitation Superintendent
may approve and authorize below ground containers for use.
Containers shall be removed no later than 8 : 00 p.m. on the day
of collection. It shall be unlawful for anyone to use an
alley container unless such person is a resident in that City
block backing onto the alley or an agent or employee of a
person in the block. "
SECTION 3 . Section 17-8 is amended to read as follows :
"Any person desiring to place tree trimmings or hedge cuttings
for collection, shall cause the same to be securely tied for
collection in bundles not heavier than fifty (50) pounds nor
more than five (5) feet in length and eighteen (18) inches in
diameter. These shall be placed with other garbage and trash
for pickup at the regular time for collection. If more than
three (3) bundles are removed at any one pickup at any one
time, an additional fee shall be charged for the additional

hauling. The charges shall be fifteen dollars and 75/100
($15. 75) per hour for provision of a dump truck for hauling
to the landfill , and six dollars and 25/100 ($6 . 25) per hour
per employee for the labor used in the removal. The minimum
charge for additional hauling as used in this section shall
be five ($5. 00) dollars . "
SECTION 4. Subsections (a through d) of Section 17-14 is amended
to read as follows :
" (a) Rock, waste, scrap building materials , or other trash
resulting from construction or remodeling or from a
general cleanup of vacant or improved property or from
sizeable amounts of trees , brush, or debris cleared
from property will not be removed by the City as a
regular service , but may be done for the owner on payment
of extra fees as follows:
(1) Dump truck per hour $16 . 00 (loading time plus
15 minutes travel) .
(2) Laborer per hour $ 6. 75 (loading time plus
15 minutes travel) . "
"(b) Provided, however , that all types of trash, refuse, and
rubbish will be carried by the City during various cleanup
campaigns proclaimed by the City of Wichita Falls .
During a cleanup campaign, no additional charges will be
levied for picking up properly bundled or bagged trash,
refuse or rubbish. "
" (c) During the term of any cleanup campaign in which no
charge will be levied, it shall be unlawful for the
user to load or allow to be loaded in the trailer or
disposer anything that will extend above the height
or beyond any side of it . "
" (d) Anyone who has misused, abused, or otherwise violated
the rules and regulations set out herein or by the City
Manager may be prohibited from receiving a trailer or
disposer at any time in the future. "
SECTION 5. Subsections (1 through 9) of Section 17-19 are amended
to read as follows :
" (1) Single-family unit. $ 5 . 00"
" (2) One-family unit or single family unit ,
without alley entrance, where it is
necessary to carry out refuse or garbage
for more than ten feet but less than
fifty feet from curb. $16 . 25"
" (3) One-family unit or single-family unit ,
without alley entrance, where it is
necessary to carry out refuse or garbage
for more than fifty feet but less than
one hundred feet from curb . $25 . 00"

" (8) Housing developments per unit. $ 5 . 00"
" (8. 1) Any housing units :
Ten (10) feet but less than fifty (50) feet. $16 . 25"
Fifty (50) feet but less than one hundred
(100) feet. $25 . 00"
One hundred (100) feet and over. $37 . 50"
SECTION 6 . Subsection (10 of Section 17-19 is amended to read
as follows :
" (10) Commercial and business establishments , regardless of
location shall be charged at a rate to be established by the
Sanitation Superintendent on the basis of cost of service to
be determined by the container volume or time consumed, but
no business , commercial concern or establishment shallbe charged
less than ten dollars and seventy-five cents ($10 . 75) per month.
Public , business , and commercial institutions will receive
sanitation container system service for the removal of trash
and garbage under the rates and rules herein set forth,
as routes for such service are established by the City.
Under the sanitation container system service , the City of
Wichita Falls will furnish a container or containers to be
used in the collection and removal of trash and garbage. The
monthly charges will be determined from the schedule below.
These charges are based on the container size and number of
collections per week.

Any institution which pays the rate set forth above for
containers and has been furnished the same , may upon request
be furnished additional containers . The rate increase is to
be determined by the above schedule. When containers can
serve several adjacent business institutions , they will be
required to use the same container and pay a pro rata part
of the charge determined according to the appropriate
quantity of space used. Additional pickups will be made at
sixteen dollars and 50/100 ($16 . 50) per container. Nothing
outside the container will be removed for the container fee.
Containers must be properly loaded with doors closed for
pickup to occur. Business institutions shall be responsible
for the cleaniness around the container and insure boxes
(cardboard/wood) are broken down prior to being placed in
the container. "
SECTION 7. Subsections (a and b) of Section 17-62 is amended to
read as follows :
"(a) License. The license fee for each class license shall
be as listed herein. Each vehicle so licensed shall
require a separate fee.

Class 3--$18 . 25
Class 4--$18 . 25
Class 5--$61. 25"
" (b) Landfill use fees . Fees for the use of the landfill
shall be at the rate of six dollars ($6. 00) per ton
for garbage and trash originating from within the city
limits and twelve dollars ($12 . 00) per ton from out-
side the city limits . Weights shall be determined to
the nearest one-quarter (1/4) ton and charged accordingly,
except that the fee for a load of less than two hundred
fifty (250) pounds originating from within the city
limits shall be one dollar ($1. 00) . Fees for each type
license and use are as follows :
(1) Refuse from a Wichita Falls residence which is
assessed the residential rate may be disposed of
at the landfill without charge . If rental property
is involved or if the hauler is being compensated
for the hauling a landfill fee will be assessed.
The Sanitation Superintendent or Landfill Supervisor
shall have the authority to determine if a fee is
to be assessed for questionable situations .
(2) Class 1 : Six dollars ($6. 00) per ton with a minimum
charge of one dollar ($1. 00) , charges to be accumulated
on a monthly basis. Monthly total will be billed
subtracting the ten dollar and seventy-five cents ($10.75)
minimum rate for commercial establishments. No
monthly rate will be reduced below minimum fee but
all charges in excess of the minimum fee will be
added to the monthly utility bill.

(3) Class 2 : Six dollars ($6 . 00) per ton with a minimum
charge of one dollar. Charges to be accumulated on a
monthly basis . Charges so accumulated will be added
to the monthly utility bill.
(4) Class 3 : Twelve dollars ($12 . 00) per ton, minimum
charge three dollars ($3 . 00) . Fee shall be collected
upon entrance to landfill by cash, coupon or
prearranged charge account.
(5) Class 4 : Rate to be charged upon origination of
garbage. Six dollars ($6 . 00) per ton for inside
city limits or twelve dollars ($12. 00) for outside
city limits . Payments shall be prearranged method,
to be arranged upon issuance of license.
(6) Class 5 : Rate shall be determined by the origination
of the garbage or trash. Rate shall be six dollars
($6. 00) per ton for inside city limits and twelve
dollars ($12 . 00) for outside city limits. Payment
shall be on a prearranged basis , to be arranged upon
issuance of license. "
SECTION 8. The above schedule of refuse rates shall be effective
on all bills rendered after the 30th day of September , 1981.
SECTION 9 . The fact that additional revenue is needed in the Public
Works Department during the fiscal year beginning October 1, 1981, in
order to meet the cost of providing the service levels to be performed
creates an emergency; this ordinance is declared an emergency measure
and shall be effective upon its passage.
