Ord 3844 10/20/1981 ORDINANCE NO. J14e1/ ORDINANCE AMENDING SECTION 32-21 OF THE CODE OF ORDINANCES, TO REVISE THE CRITERIA FOR UTILITY DEPOSITS OF PERSONS 65 YEARS OF AGE OR OLDER. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Section 32-21 of the Code of Ordinances is hereby amended to read as follows: "Section 32-21. Deposit Required. (a) All persons desiring to use City water shall make a money deposit with the Utility Collection Division. The amount of said deposit shall be a reasonable sum to protect the City from loss due to unpaid bills and shall not substan- tially exceed the estimated amount of a two month bill and in no case shall be less than $20 for each service connection. (b) A person who is 65 years of age or older and who has been a customer in good standing for at least one year may apply for a refund as provided for in (f) below. (c) In order to be a customer in good standing, the customer must not have: (1) allowed his City utilities bill to have become delinquent more than three times within the preceding twelve month period; or (2) attempted payment of his City utilities bill more than one time in the preceding twelve month period with a check that was not honored by the bank. (d) A new customer 65 years of age or older must submit satisfactory proof of his age. (e) A customer shall lose his exemption from the deposit requirement if he fails to maintain his good standing, and he shall immediately be responsible for depositing the proper amount. The deposit requirement shall continue until the customer reestablishes his good standing. (f) Any person 65 years of age or older, who has a money deposit with the Utility Collection Division, will have his deposit refunded to him if he is a customer in good standing, and he files an application for such refund, with satisfactory proof of his age, to the Utility Collection Manager, and such application is approved by the Utility Collection Manager.
