ORDINANCE GRANTING AUTHORITY TO WILSON
MANUFACTURING DIVISION OF CONTINENTIAL EMSCO
CO. TO CONSTRUCT AN EMERGENCY POWER SERVICE
ABOVE THE ALLEY, AND A FUEL SUPPLY LINE
BENEATH THE ALLEY IN BLOCK 150 OF THE ORIGINAL
TOWN OF WICHITA FALLS .
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS , TEXAS, THAT:
SECTION 1. Wilson Manufacturing Division of Continential EMSCO
Co. is hereby granted the right and authority to construct
an emergency power service line crossing above the alley in
Block 150 of the Original Town of Wichita Falls, which line
shall have at least 32 feet of clearance above the alley.
In addition , such company is hereby granted the right and
authority to construct fuel lines crossing underneath such
alley. Such facilities shall be constructed in accordance
with the attached letter dated November 16, 1981 from M. A.
Vordenbaum & Sons, Inc. , and the attached drawing.
SECTION 2 . Said Company shall coordinate such project
with all utility companies whose facilities are located in
the alley.
SECTION 3. It shall be the responsibility of such company
at all times to maintain said facilities at its own expense.
If at any time in the future some public use of such alley
makes it necessary that the emergency power service line
and/or the fuel supply lines be relocated or removed, such
relocation or removal shall be done at the sole cost and

expense of such company. Unless sooner removed, such company
shall remove the emergency power service line at its sole
cost and expense within 18 months after the adoption of this
ordinance.
SECTION 4 . Whenever any work is being done on the
construction or maintenance of said emergency power service
line and fuel supply lines, such company shall take all
necessary and proper precautions to protect the public from
damages. Such company shall hold and save the City of Wichita
Falls harmless from all damages or claims for damages resulting
from the construction, maintenance and location of such
facilities.
SECTION 5. The right and authority hereby granted for such
emergency power service lines is for 18 months after the
adoption of this ordinance, and thereafter it shall be removed
by the company at its sole cost and expense. The right and
authority hereby granted for such fuel lines is for so long
as they are used and maintained by said company. When they
are no longer so used, they shall be removed by said company
at its sole cost and expense.

Dear Mr. Lillard:
As per your request, this is our formal application for an overhead easement
between the Owens Garage Building and the above referneced building. We are making
this reuqest in behalf of the The Wilson Oil Rig Manufacturing Company, a subsidiary
of The Continental Emsco Co. Wilson Manufacturing is a tenant in the Atrium, 3rd
floor. The Atrium and the Ownes Garage are both owned by the same person. They
have leased space on the 3rd floor of the Ownes Garage Building to install a UPS
(uninterrupted power supply) system for connection with a very large computer operation
housed in the Atrium, 3rd floor.
The UPS system will allow the computer to operate during power outages and will
provide "clean" power under normal conditions. Due to the extreme weight of the
batteries and the poisonous, explosive gas emitted by the charging batteries, the
owner has agreed to place this into the Garage rather than the office building.
Adequate ventilation and other construction will be installed per the present
building codes for commercial construction.
The cross over structure above the alley, between the buildings will consist
of a single wide flange "I" beam with electrical conduits attached to it. The
approximate clearance under this structure will be 32' . Please refer to the
attached drawing.
Also, Wilson Manufacturing has agreed to agree to a legal instrument which
would 1) hold harmless the City of Wichita Falls for all liability concerning the
structure and 2) would remove, totally, the structure as installed within 18 months
from final approval.
We have presented this project to the Electrical Review Board of the City of
Wichita Falls for their approval of the electrical portion of the work. They approved
the work pending submittal of properly engineered electrical drawings. They also
recommended additional electrical safety measures which will be adhered to in the
final design.
