ORDINANCE AMENDING ORDINANCE NO. 16-2002, TO SUSPEND
2222 JASPER FROM THE DEMOLITION LIST APPROVED BY SAID
ORDINANCE, TO ALLOW THE PROPERTY'S CURRENT OWNER
ADDITIONAL TIME TO REHABILITATE THE STRUCTURE; FINDING
AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, at its meeting of March 5, 2002, the City Council held a public
hearing on certain hazardous structures, and passed Ordinance No. 16-2002 which
declared those structures as dangerous, in violation of ordinance, and commanded
certain action with regard to same; and,
WHEREAS, the property located at 2222 Jasper Street in Wichita Falls was
included in the list of structures declared as dangerous under Ordinance No. 16-2002,
and the owner of the property was ordered to demolish the structure; and,
WHEREAS, the then-owner of the property subsequently sold it to its present
owner, who was unaware of the demolition order imposed by the City Council through
Ordinance No. 16-2002; and,
WHEREAS, the current owner desires to rehabilitate the structure and has
agreed to provide the City with a site plan, cost estimates and proof of financial
feasibility; and,
WHEREAS, the current owner shall deposit into escrow the sum of $2,622.00,
which is the current cost to complete demolition of the structure, should the required
rehabilitation work not be completed; and,
WHEREAS, the rehabilitation of the property is in the best interest of the public
and the City of Wichita Falls.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Ordinance No. 16-2002, which declared certain structures as
dangerous and commanded certain action with regard to same, is hereby amended to
allow a stay of the pending demolition of the property at 2222 Jasper Street in Wichita
Falls for 150 days from April 16, 2002, to allow the property owner to complete all
necessary repairs and obtain a Certificate of Occupancy on or before
September 13, 2002. Should the owner obtain such Certificate of Occupancy on or
before September 13, 2002, the order of demolition of 2222 Jasper as required under
Ordinance No. 16-2002 shall be terminated. However, if the owner does not make
significant progress toward rehabilitation within 90 days or shall fail to complete the
necessary repairs and obtain such Certificate of Occupancy on or before September
13, 2002, the stay of demolition of the property at 2222 Jasper shall be lifted, and the
demolition shall proceed as ordered under Ordinance No. 16-2002.
SECTION 2. In consideration of this stay of demolition, the owner of the property
at 2222 Jasper Street shall deposit into escrow the sum of $2,622.00, to cover the
current cost to demolish said structure, should the required rehabilitation of the
structure not occur within the 150-day time period. In addition, the owner agrees to pay
any additional demolition fees, should the cost to demolish the property at the end of
the 150-day period be greater than the sum in escrow. If the owner fails to pay said
additional fees within thirty (30) days, a lien shall be placed on the property. However,
should the owner complete all repairs as required by City codes and obtain the
Certificate of Occupancy on or before September 13, 2002, the amount in escrow shall
be returned to the owner.
SECTION 2. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
